Really, why do people not read the auction description in the end they get what is advertised and no offence is commited.

That one is different though, as it mentions it is an empty box about 50 times, and it is listed as being a box. The other auction is listed as being a wii.
I don't see the problem?

He has clearly stated what is for sale, and hasn't tried to hide the fact (as some scammers) do.

He listed the item title as nintendo wii. Nothing about a picture. Whilst you may not see anything wrong with it, Ebay do:

    Misleading Titles

Sellers are not permitted to create titles for their listings that do not accurately describe the item for sale.

Violations of this policy may result in a range of actions, including:

    *

    Listing cancellation
    *

    Limits on account privileges
    *

    Account suspension
    *

Forfeit of eBay fees on cancelled listings
    *

    Loss of PowerSeller status

    Some Examples

    *

The title "Louis Vuitton Handbag, Cartier" is inappropriate and not permitted on eBay (even if a Cartier item is included as a bonus gift with purchase of the handbag) because it is unclear as to whether the seller is offering one or two items from the title.
    *

If a seller lists an auction simply as “Apple iPod”, the seller must be selling an actual Apple iPod – not accessories to an Apple iPod – or items related to or unrelated to an Apple iPod.

Why does eBay have this policy?

eBay has this policy in order to support an efficient shopping experience on eBay for all members by ensuring that listing titles accurately describe the item being listed.

its the buyers fault for be unable to read.

People with dyslexia would fine the original listing difficult to read as being a picture. Are you saying therefore they should be punished?

The second item (as quoted in my post above) would be fine for a dyslexic as it makes it quite clear it is an empty box.

The fact remains, it was not just in the wrong catagory, the title was also wrong, which is in breech of Ebay rules.

So if I list a car and put the title as 'Ferrari F40' but in the listing I clearly put that it's just a scale model I would be breaking Ebay rules? :D

At the end of the day, does anybody out there believe that this guy wanted to honestly sell a picture and intended the buyer to fully understand what they were getting for their money?

Or on the other hand, are we all agreed that he fully intended the buyer to believe they were getting a wii and bid appropriately and that we are actually only arguing about the morals and whether he played within the rules or not?

Lets all put stupid listings on. Everybody can then spend hours trawling through fake listings just to find a real product. Great idea
