Anglian Windows mis-sold PPI

    Who was the insurer? Did they subscribe to the GISC code. If they did then they breached it by accepting business from an intermediary that did not and you have grounds for complaint against them.

    Haven't a clue who the insurer are as we have no documents regarding the PPI.

    Our claim is currently with the FOS who have contacted us to ask if we know the underwriters, they are trying to track them down but there is no mention of them in any of the documents we have been provided by Anglian.

    PPI Success :- Egg Card - £ 8471.84 ~ HFC Loan - £ 8312.67 ~ Halifax Loan - £ 334.67 :D
    DFD ~ Jan 2019 :eek: Christmas 2014 fund ~ £ 150 / £ 500

    It looks like you are stuck then.

    I suppose you could write to Anglian and accuse them of fraud by charging an insurance premium but not arranging an insurance policy and providing you with a policy document.

    It might then miraculously turn up.
  • There is one other angle you might want to use but probably needs views from Magpiecottage or other legal begals on whether it has legs.

    The Anglian loan model offered the discount only on the basis that the customer opted for PPI. On this basis, the PPI premiums becomes a conditional part of the loan arrangement and any cost that is a condition of the loan must be reflected in the APR quoted. I don't believe the PPI costs were reflected in thre APR presentation and if this was the case, the agreement is uninforceable in any court of law.

    It might be a bit late to use this but might put the frightners on them anyway as it has bigger repercussions than PPI refunds!

  • Hi all this is my first time on this site, and have been reading the issues with claiming back ppi from Anglian Windows. They seem to be telling people they were not under the rules of FSO and so tough. and from what I can see the FSO are agreeing with them.

    Has anyone won their PPI back from Anglian windows, either via doing it themselves or via a claims company. I got stuck with PPI which I didn't want as I had a secure job, full pay if sick and private medical cover ( also the PPI only lasted 5 years and the loan was 10) so seemed pretty useless to me and have not taken PPI out on anything else.

    Comments from this site are putting me off claiming as claimants seem to be getting nowhere :(

    Anyone with any good news regarding anglian ?

  • I am also keen to hear if anyone has had any success in reclaiming from Anglian. I had two loans from Anglian for double glazing. First in 2003: Anglian says not covered by regulations, full stop. Second in 2005: Anglian says the cost of PPI was less than the discount given for taking out the loan and therefore the FOS will say they don't owe me anything even if the PPI was mis-sold.

    Their representative told me they have 93% success rate in contesting claims that go to FOS.

    So I would be pleased to hear of anyone who has had success claiming back from Anglian.

    The discount was not for the PPI it was just for the finance, send this to FOS.

    Did you pay one payment each month to this loan and PPI and not a separate payment for the PPI? if you did, this is Single Premium PPI and this is the reason for mis sell that you use, this was a loan on the loan paid to term end with interest, if you cancelled the PPI they would have given you a pro rata rebate of the PPI and the remaining PPI is still on the loan to term end.

    If you settled this loan early then, as above you, would have a pro rata rebate and you would have paid back the remaining PPI in with the settlement figure.

    In that case, for complaints about sales from 2001 to 2005 (when Anglian became subject to FSA regulation) you CAN complain to Cardif Pinnacle that it breached the code by accepting business from an intermediary that did not subscribe to it. But for that breach you would not have been missold its policy and therefore it must redress you.

    Anglian do not appear on the FOS published lists - which apply to firms with more than 30 complaints in six months.

    So they could, for example, have had 414 complaints referred to FOS and only 29 of them accepted for investigation - i.e. 7%. Those could all have been upheld and not show in the published stats. The remaining 385 (the 93% they refer to) would be "successful" in the sense that FOS agreed that they could not investigate.
  • Thank you both. I will send the 2005 case to the FOS and write to Cardiff Pinnacle about 2003. I'll let you know how it goes.
