Anglian Windows mis-sold PPI

    Thanks for the reply and the advice. I will do as you say and write back politely before going to the FOS. I agree that the loan and the PPI are two separate issues.
    I had so many reasons for not taking the PPI: life insurance, 6 month full sick pay and money in the bank to cover. The sole reason I took the PPI was that I was told I had to have the loan to get the £2065 discount, to get the loan I had to have the PPI. The PPI was optional, but without that no loan, no loan no discount.

    then that is a miss-sale and will be upheld by the FOS, as you should have been able to take the loan without the ppi and still get the discount
    I'm proud to say that the banks no longer take money from me after becoming debt free

    I agree, feel much better about this one now.
    Was never happy with this deal from the off, but the promise of superior quality and a colour match to existing Anglian work, I was pulled in. As it happens the work was shoddy and the finish of poor quality, I must have had them back at least 6 times to sort out the various problems. In hindsight stick with the honest local family run business and get none of this hassle.

    I was wondering how you were getting on arguing this out with Anglian?

    I'm in the same position as yourself having just received a reply from GE Money passing the buck and my complaint to Anglain. Waiting to see what Anglian have to say but curious if you have got anywhere with your complaint as your a few months ahead of me in the process.

    Have today received a 'Final Response' letter from Anglian.

    'The sale of general insurance did not come under the remit of the FSA until 14th January 2005 and any sales prior to this date are known as pre-regulation: the regulations are not applied retrospectively. From the details I have your sale was conducted in 1999. For any purchase of insurance prior to the 14th January 2005, you were deemed to have chosen freely whether or not to chose to purchase the insurance. The sales representative did not have to assess your demands or needs; it was your decision whether the policy was suitable or necessary. A policy summary is provided, although the full terms and conditions would have been sent by the insurer.

    When arranging the finance and insurance cooling off period is provided, giving you time to cancel should you not wish to proceed. Signing the credit agreement is taken as acceptance of the full terms and conditions. Considering the regulations at the time I do not agree that the policy was mis-sold.

    I would advise you that prior to the 14th January 2005, Anglian was not a member of the ABI or GISC or FLA and were consequently not bound by their codes of practice.

    What can I do now, their letter seems pretty final and I don't agree with us choosing freely to have the PPI it was simply put on the forms without out our express consent. In fact it was more a case of 'you have to have this' from the sales man :(

  • Anyone made any advance on Anglian windows for a claim - we've just found out that we have been paying PPI since 2004! And to make it worse we seem to have 2 policies - one direct with GE in my wives name (which we didn't request) and the other with Anglian directly in my name! ???

    I too would be interested to hear if anyone has had any success claiming missold PPI from Anglian
    he's not the Messiah, he's a very naughty boy !

    Who was the insurer? Did they subscribe to the GISC code. If they did then they breached it by accepting business from an intermediary that did not and you have grounds for complaint against them.
