    Before doing anything else pay a visit to the security team located on Parc Llandudno itself, they are able to "void" each and every ticket and are in contact with parking eye. They are able to "void" every single parking fine for legitimate shoppers. So please, consider this option before parting with even more cash.

    Sorry but the security cannot "void" any parking fines for one very simple reason.

    PARKING EYE CAN NOT ISSUE PARKING FINES!!!!!!

    Parking fines can only be issued by the Police or local authorities. Private companies by law can not issue fines or penalties for parking or for anything else for that matter. Parking Eye's business model relies on shoppers being ignorant of law and being mislead into paying one of their demands. The law stipulates that private companies can only seek to recover a "reasonable pre-estimate of losses suffered", i.e. if you under pay by £1 they can seek to recover £1, etc. If you owe £1 and Parking Eye send you an invoice for £60 (DON'T FORGET IT'S AN INVOICE NOT A FINE) then that's clearly going to be unenforceable in a court of law because it's not a reasonable pre-estimate of losses suffered.

    The sooner people realise that these are not "fines" the better it will be for all of us.

    Probably could do with it's own thread, but ASDA now have ANPR camera's installed. So can expect to see a few people getting caught out by them.

    It should be interesting around Christmas time when people do a full Christmas shop and then find themselves having to queue for 45 minutes to get out of the car park. And then get sent a fake fine for overstaying by 15 minutes. Should be great publicity for Asda that!

    In the meantime I'll make sure I do all my weekly shops at Tesco in the Junction instead just to be on the safe side ;).

    A few tesco's have ANPR, so may only be a matter of time before the one in Junction adopt's it.

    Just remembered, need to look at the sign in Asda. Am sure it is the old one, when they had the guy patrolling. IF so then they could be in breach of whatever code regulates these people. :)

    I'm hoping Tesco don't get ANPR in the Junction. Their car park isn't in a location where it's going to get used and abused by non-shoppers so they don't really need it, unless of course they want a way to rip even more money off their customers. If that happens I'll have to move on Morrisons in Colwyn Bay.

    And I doubt whether the BPA would be too bothered about any breaches in code. I'm sure they'll find their member has acted correctly, regardless of the actual circumstance. That's the problem with self regulated industries.

  • I have now been in receipt of several letters from parking eye and am now at the stage of being in receipt of a 'Notice of Intended Litigation' which has come to me via Debt Recovery Plus.
    Now, my instinct is telling me that these pirates are being serious about this, while i have read through so many posts on this forum with regard to Parking eye, all of which say IGNORE, it'll go away, has any one person who has posted on here actually have a Law degree and is able to tell me quite categorically that this is not enforceable, or, is everybody in receipt of notices from Parking eye and the companies they are in bed with, just winging it and burying there heads in the sand. I cant afford to pay it, but i can less afford the cost of going to court to fight it!
    What do i do?

    First off I'd suggest creating a new thread in the Parking Fines forum as that's where the parking experts are - http://forums.moneysavingexpert.com/forumdisplay.php?f=163. You'll also find that just about every other thread there is about Parking Lie so you're not the only person they're causing unnecessary worry to.

    Parking Lie have recently started sending out court papers to some people who haven't paid them so the advice about avoiding has changed a bit recently. If you do get court papers there are people who will help you out (free of charge) both on MSE and on Pepipoo. The consensus seems to be that Parking Lie are sending these court papers out in order to scare people into paying, which could be deemed as an abuse of the court system.

    So far none of these new cases appear to have reached a court so it's too early to know if they'll actually turn up on the day, one thing that is for certain is that they won't have anything like enough people to to attend every hearing if everyone who receives these papers puts in a defence (with help from Pepipoo of course).

    For anyone who receives a Parking Lie speculative invoice in future there's a new way to get this overturned using POPLA - again I'd suggest creating a thread in the Parking Fines forum for proper advice on what to do. The great thing about POPLA is that it costs them £27 + VAT for every appeal and while the appeal decision is binding on them it isn't binding on you :D.

    p.s. Debt Recovery Plus are a toothless company with a cynically chosen name which is supposed to mislead you into thinking they're something they aren't. All they can do is send you threatening letters but remember that unless you get taken to court and lose (which is extremely unlikely) then there is no debt for them or anyone else to recover.
