    The ESA test is the WCA (work capability assessment) is different to the IB test (Personal capability assessment).

    There are very few who will not have to have a medical under the new rules; the exemptions on the old rules no longer apply.

    Hi, just a question for any of you. If you fail the medical for ESA and appeal, does that mean you have to start sending Sick Certificates in again?
    I have been on Incapacity Benefit for a few years due to depression anxiety etc. I dont really go out the house so dont visit the GP regularly as no treatment worked and we tried loads of different ones for ages so now i just deal with it myself. So if i fail the medical for ESA will i need to start going to the GP all the time again?
    I havent received a phone call from ESa but have received a letter with the forms to fill in. I need to send them back by beginning of august.
    Also how long after i send these back will the appointment be?
    Any advice?
    Any help will be appreciated.

  • Hi, in answer to your questions, yes, if you fail to gain enough points at the WCA assessment and go to appeal you will have to start sending in fit/sick notes again as you will not have passed the criteria to receive ESA full rate and will be on the assessment rate while the appeal is ongoing.

    I sent my forms back last month and had the phone call regarding the assessment date within a week. The assessment was 10 days later. I then had the letter placing me in the WRAG group 2 weeks after that so was lucky as it was quite quick. I now have my first Work Focused Interview next week so within 3 weeks of receiving the assessment result.

    Hope this helps. I know mine was quick compared to a lot of other people so be prepared for it to take longer. Best of luck and try not to stress too much (easier said than done), I was worried sick but it was not as bad as I expected.

    Greatly increased over what time period? For what particular benefits?

    And what does an increase in claims have to do with fraud?

    The Social security Advisory committee has already publicly stated his previous work, where he claimed a massive percentage of IB'ers were fraudulent has no evidence base.

    The guy should be prosecuted in my opinion for disability hate crime, as he is spreading lies against the sick and disabled.

    Agreed, even the exception for those in a permanent vegatative state has been removed. Just in case they actually are fit for work, despite a hospital consultant confirming officially they are in a permanent vegatative state.

    As usual Cit_k you have hit the nail on the head!

    I don't think for 1 moment the condem coalition have thought this whole thing through I really don't think they have a clue what this means for an awful lot of innocent people who have proven for years under the old IB test they are not capable of work for whatever reason. The amount of unneccessary stress and worry this is already causing people should be criminal really and not to mention the complete waste of tax payers money to make the change to begin with! Why are they bothering honestly? Would it not have been better to sort all of this in one go when the so called "universal credit" comes in? I still believe that will be pie in the sky time will tell.

    i'm worried about losing my ib, one because the form i had to fill in for esa the questions were somewhat rediculous .. i had a question asking if i could pick up an empty box ... with a yes or no answer ... well i may have excruciating back pain that affects my ability to walk but my hands work .. so i know when i filled out the form i probbaly haven't given enough information ..
    I Will have to go for a medical and i feel my doing a degree etc and wanting to get a job will mean they declare me fit for work .. but then i will be screwed because im a student i will not be able to claim jsa , and i have been trying to find a job but obviosly i have limitations and i havent been able to find one in the last 3 years so i will have no money.
