    sorry to sound a bit thick, but what is assesment rate?
    I'm currently on IB but had a letter and phone call telling me they are moving me over after questionaire etc.

    Would you still be able to claim assesment rate if your partner was working?

    Someone making a new claim for ESA will recieve the Assesment rate for the first 13 weeks of the claim, before being moved to one of the main rates. IB/IS/SDA claimants will be excused the assessment phase when they are being transferred to ESA and will continue to receive their existing benefit until a decision is made.

    If you need to appeal the decision becuase you have failed the medical, you will receive the assessment rate until your case is heard.

    As I understand it, because you were on IB which is a contribution based benefit, you should be able to claim the assessment rate as an individual and therefore your partners income should not affect it.

    The assessment rate for a single person over 25 is currently £67.50

    If you fail the medical then you can claim the assessment rate until while you are waiting for an appeal to be heard, if you don't appeal then you won't get anything.

    If you are successfully transferred to ESA the you will receive Contribution Based ESA, which is not affected by your partners income.

    You will only go on contribution based esa if you have paid enough NI - the OP of this thread is on contribution based IB so I would imagine they would go on cont based esa - however your circumstances may be different.

    If you go on income related esa then your partner's earnings will be taken into account.

    if you are claiming dla at middle or high care and fail the esa medical then you will get the same money if you get dis prem/severe dis prem/enhanced dis prem while appealing you will also get them if you opt to claim jsa ib the following link explains which premiums are paid and with which benefits

    Yes sorry was not aware that IB is only cont based ( never claimed it, I could have done, but never did)

    The other point to be made is that if you pass the WCA but are placed into the WRAG rather than the Support Group which you think you should be in and appeal you will continue to get ESA at the WRAG rate rather than drop back to the Assessment rate until your appeal is heard.
