They forgot to mention that "Civil Procedural Rules 31.16" does not apply to the Small Claims Track. I wonder why?

If you have any worries, the Civil Procedures Rules are here http://www.justice.gov.uk/guidance/courts-and-tribunals/courts/procedure-rules/civil/contents/parts/part31.htm#IDAALGT while you are getting to 31.16 be sure to read 31.1(2) that states:

"This Part applies to all claims except a claim on the small claims track."

Given they would have to take a claim to the small claims court, they have kindly shot themselves in the foot while trying to scare you :rotfl:
