Heya,
First time posting, hoping someone will know what they are talking about.
In June 2011, my partner recieved a letter at his parents address from a debt collector claiming he owed Vodafone over £300.
He had no idea what it was about as he had never been contacted by Vodaphone and was under the impression he had paid off his contract years ago?
He was told his last payment was made in July 2007 and if he's paid it off all he has to do is proove it to them with a bank statment. But that wont proove anything, it'l only confim the made a payment which they already know?
He has asked them to have Vodafone contact him to confirm it is a legit. debt and explain why they never contacted him. The debt collectors will not do this. They are constantly calling him up demanding that he pay the money owed and being increadably cheeky with him?
What I want to know is can a debt be sold on to a colletor when no attempt at contact/ notification of the debt was made?
Is it legal for them to have waited over 4 years before contacting about a debt?
And will he have to pay it when the debt collector is refusing to send him any proof from Vodafone that it is a real debt and how it came to be. ie he missed a payment or he still had £1 to pay and its mounted up in interest...... if that is the case is the debt legit since they never sent him a bill for the small amount and instead allowed it to mount up?0 -
