estimating bank charges over the years

    In fact they have probably read the BBC website where it suggests if you don't have a "few" statements you can estimate your claim and it gives you a letter to use.

    I hate the BBC recommendation with a passion because sadly this isn't the first person to say they have done this.

    As iceliquid says, the OP has no alternative but to try and stop the claim and start again from the beginning
  • I think I get the message I've done this wrong. Thanks. Should I adjust the amount I am claiming to just the 2K that I categorically know I was charged. Can I do this on my original small court claim or should I stop the claim completely and start again?

    I know I have cocked up but I did follow advise that told me to estimate the amount if I only had partial statements.

    i am owed 2665 by the halifax for the last 4 yrs and the intrest comes to 491.37 don't know if this help's but thought i would let u know good luck with your claim,don't give up that it's what the bank's wan't u to do.

    Its not a case of giving up, its a case of getting it correct especially in view of the person who took on Lloyds with an ill prepared case.

    Phone MCOL or if you filed at your local court get in touch with them and ask them if you can "suspend" your claim for say a month until you can get the correct figures and start again.

    And the next obvious step would be to do an SAR for the missing statements.

    A rule of thumb that will stand the OP (and all others for that matter) in good stead for future law proceedings...

    If you don't know what you are doing, don't do it until you do know what you are doing.

    i did not mean to say u where giveing up,but you are right in saying u need to get it right these big coprate bank's think the law can not touch them and they can rip joe public off well they are so wrong,i am only at the stage of asking for my money back off the halifax but i think they are going to drag it out as long as possible,so all i am saying is(after reading post asking should i give up)nooooo,,,they may be multi-million pound company's and can afford the best lawyers but they are in the WRONG.

    Yes.... but you need to prove they are, and to do that you need to make sure your facts are correct before taking legal action.

    yep,,,totally agree with u but how much proof do we need to present to the court,there is that many loop holes in the law.

    In civil proceedings it isn't about "reasonable doubt", it's about "weight of probability", i.e. all you have to prove is how likely what you are saying is true.

  • I am going to ask if I can suspend the hearing and get the full 6 years statements. If I can't suspend it, I will withdraw it completely as I cannot face court costs etc. Do you think I will be able to withdraw now? Does anyone know?
