estimating bank charges over the years

            Hi there,
I wonder if anybody can help. I've only got my last two years bank statements from Abbey and have now written to them 4 times and authorised them to take £10 from my account to cover the cost of sending me the other charges both in writing and over the phone. This has taken 9 weeks so far and I only have standard responses telling me they will reply in another 4 weeks. Can I take them to court with an estimated amount or can I only start proceedings on an amount I can prove was taken from my account?
Although I authorised them to take £10 from my account, they have not done so yet so I'm afraid the 40 day rule doesn't apply.
I suspect this is delaying tactics in advance of new ruling.

You would be better off sending a cheque. You can't go to court with estimated charges. You need to read the Step by step guide in my signature and follow it in order to reclaim your charges.0 -

did you send the correct DPA request with 310 originally - then abbey wrote and said pay a further £10 for fiche ???
Abbey are bound by the DPA as much as any one else. The ICO have deemed fiche relevant and should be supplied within the 40 days. YOu should send them a seven day letter saying you want the statement or you will report to the ICO and if necessary take them to court to enforce the DPA compliance.
If you have any queries about doing this please ask.
Andwer the first question first tho
Oh and please dont panic and hack you claim in wrong to beat the OFT it is unlikely it will make a blind bit of difference

            Hi,
Can anybody give me advice on what steps to take. I filled and sent template letters from the BBC money page. I then discovered this site. Can I now send the next letter using the templates from this site?
Also after looking at the advice on this website, I have over estimated the charges to be recovered. Will my claim be affected due to over estimating the charges?

            I hate the BBC advice with a passion as yes, estimating your charges can affect your claim as you need to produce your list of charges as part of your evidence should this get to the court stage.
Personally I would suggest starting by getting your information/statements and work out your charges exactly and then carry on with your claim as per Martin's article.

            Hi sorry if i appear to be a bit dumb !
i have sent off my initial letter with statements etc but recieved a letter to confirm they had recieved it they then wrote again after 4weeks to say they were still looking into it, what do i do now? do i wait and see or write again threatening court action. and if i do that is there a standard letter for that? and if so where ?

            thanks for that although just looking at the letters to send and it says about a schedule of charges, i sent my claim in based on an estimate and the abbey have not sent a list of charges as requested on first letter.0

            Sounds like you have used the BBC website letters. Not recommended on MSE, read Martin's article and the Reclaim Help Thread and I would suggest you start again.
