Employers also use the vehicle when an employee is driving.

The above asside, obviously the bus co will be liable. One wonders whether the road is suitable for a bus and the route is correctly registered with the traffic commisioners? Traders can tax a car as they are the 'owners' until the car is sold, I have been offered this before when looking at second hand cars.
The owner of the brand new BMW is going to be out of pocket by not being insured. Forgetting the legalities of cars having to be insured on public roads, the bus firms insurance wouldn't cover him from what I can gather. The insurance would need to be paid to the BMW owners insurer, which he does not have.
The bus firm will report the accident and the insurer will find that they are uninsured and best case scenario for BMW owner he hears no more about it, worst case scenario the BMW owner will be hearing from the police regarding the incident.
Although he was not at fault it makes no difference as far as the law is concerned and I feel the insurance company will take the same view.Comping wishlist for 2017

Yes they can, for second hand cars because they may have tax left on them. But with a brand new car it is different. The dealer can only tax it with the buyer's insurance cover. Why would the dealer tax it using their own insurance when the buyer refused their '2 week' cover?
As for the rest of your post. i'm sorry but thats absolute tosh. Yes, the buyer has (apparently) kept the car on a public road without insurance which is an offence. But the damage side of things is a sperate issue. The buyer dosn't need his insurers to act on his behalf if he so chooses, he can simply sue the bus co for the damage if their insurers don't pay out.PLEASE NOTEMy advice should be used as guidance only. I've seen literally dozens of these types of incidents eg uninsured driver in a non fault accident, it's very unusual for the police to take any action about the no insurance unless they attended the scene. They sometimes make enquiries or take action if it's someone of interest to them.
An Insurance company would not normally bother reporting the uninsured driver to the police, I would guess the bus company won't bother either.
Good luck to him getting money out of a bus company as they hate paying out, they will probably take into account depreciation whereas if he had a normal insurance policy and the car was a write off they would replace it with a brand new car in the first year of ownership from new (Two years with some companies)0 -
Asside from the fact that this all sounds like urban myth....
The bus company has only two options
1. Pay the guy for the full cost of repair or for another brand new BMW whichever is cheaper, however, given the newness of the vehicle it would not be unreasonable for the owner to demand the full cost of purchase rather than accept a repair to the vehicle. And don't tell the police
2. Exactly as option 1 except that they report to the police there was an uninsured car on the road which got damaged
Whatever the case the bus company is 100% liable for the replacement costs.
The police will probably not be interested. The police cannot impound the car because they have not witnessed it being driven uninsured S165A I believe.
Best case for BMW he gets full refund from bus co. and hears no more about it.
Worst case for BMW he has to fight in the court for a full refund from bus co (and he will definately win). and he gets a police ticket for having an uninsured car on the road.....which is going to be chicken feed compared with the cost of the BMW.
For the dealer to release the car it would have to be taxed, to tax it it would have to be insured so this bit of the story does not add up.
And yes, if you have the right policy wording you can drive your mates Veyron even if your mate has no insurance on his Veyron.0 -
When I read this it reminded me of an accident that my little sister witnesses. The speeding car rolled over several times, and my sister was absolutely certain that the driver was dead, but was surprised when a women who appeared to be uninjured got out of the car!! She kept on repeating the same phrase: "it's a Porche" (it was).0

In speed reading this thread - is it possible that the tale has been subjected to Chinese whispers? Maybe the BMW guy was insured but didn't want to claim through his own insurers and wanted the bus company to sort it out. People have funny views on how they want the opposing insurer to sort everything out at the drop of a hat.The man without a signature.0

The bus driver owes the BMW driver compensation for the damage he caused. Because the bus driver was insured, the insurer will pay this to the BMW driver instead of the bus driver having to pay. It's as simple as that and whether the BMW driver was insured or not is irrelevant as he was not at fault. If an insurer attempted to withhold a payment for the reason you suggest they would be taken to the Ombudsman or a court and lose instantly.0
