denied insurance claim :(

I am new here

I happen to lose my iphone 4 on a late Friday evening training it home from work. As I cam out of the train station I realized it started running quite heavily and decided I run home in order to not get totally drenched. However, once I reached home i got changed to my PJs and went bed not checking my my jacket for the iphone. The next day as I was looking for my hone I relased my phone was missing and called my network provider to block the phone which they happily did.

I also called my bank to make a claim and told them what happened. They gave me the number of the insurance I was registered and told me to call them on Monday as they were closed over the weekend. Monday came, I called them, they sent me a claim form on Wednesday and at the same time I got a police report as the insurance company asked for one.

Now I just called them and they have told me that my claim has been rejected because I did not report the phone lost to the police within 24 hours. He also said it was on the T&Cs when I signed it. Now, who actually reads the t&c?

The only thing I can do is make an appeal but only if I have a good reason. I had no idea I was supposed to report it to the police within 24 hours instead of Wednesday like I did. I thought I get a police report one I receive the claims form which was on Tuesday. I don’t see what the problem is if I had the phone reported lost to the network provider who blocked it same way. No one can use it then

I need a good excuse/reason and advice as to what I can say to get the claim overturned to my side. I am really depressed now Please help. ¾ of my life was on that phone ;(

  • Have you got phone locate on your phone linked to computer. I have if I lose it I can send a message via computer asking finder to hand in or ring me or adding reward paid for return etc...sort of thing, it also uses sattelite to locate where it is?

    Must admit if I lost my phone I would report to police as soon as realised hoping it would have been handed it etc......

    Perhaps ask around.

    1 - You should have called the police as soon as you had it blocked.
    2 - I agree probably a small minority of people don't read T&C's BUT - that is not the insurers problem nor their responsibility that you did not read them - that's what they are there for - to be read.
    3 - You are asking for a ''really good excuse'' to tell the insurers so they will pay out, lying gets you nowhere and you always get found out.

    If you pay money for something it would be good to know what exactly you are paying for.
    Insurance companies spend more money on their lawyers than on compensations. These lawyers do what they are paid for:
    • produce twinged T&C with endless and pointless clauses;
    • use the above T&C and all possible excuses for rejecting the claims.
    Personally, I feel sorry for the police wasting their time on dealing with these numerous calls about the lost phones only because the insurance companies require this. It's clear that the police cannot help with getting the phone back.

    The problem with terms and conditions is that there are so many of them it puts people off reading them, many are pointless and are probably there to put people off. Unfortunately you then miss the important stuff. Sometimes you just have to suck it up and put the work in to avoid the pitfalls. I remember a holiday company a while ago with a huge list of t&c's and then saying "but here are the important ones" which was an excellent idea. I suppose another way around it is simply wait until something happens like the loss here and then read the t&c's immediately.
    It's someone else's fault.

    computersaysnoagain - unfortunately i had not set that phone tracking app up. the funny thing is i was setting it up that morning but stopped

    Mrs.C1986 - i had bank insurance for 9 years and never made a claim or had a a need for claiming on anything. but i always thought i should keep paying the premiums just in case i would need it. even if i had read the t&cs all those years ago i doubt i would have remembered to read them now now.

    the next morning, after realising it was missing i had it blocked. i called the bank up and they gave me the number of the insurance company they were associated with. however, they did tell me that the company might be closed due to to the weekend and i can call them up on monday and make a claim. i called them monday and got the papers on the Tuesday. filled them, and also went to the police to get a report. the only reason i didnt get a police report straight away was because i was under the assumption i might aswell go and get one when i get the claims paper and get everything done at once.

    im now after a valid reason. not an excuse.

    please help guys....i really need help

    Based on my experience of dealing with insurance companies you are wasting your time.
  • Sorry there is no reason to offer and as sorry I feel for you losing it, the insurance company is unlikely to budge.

    If the company was not available to report it to, then that may be your only case, assuming you reported it to them as soon as practically possible.

    I agree, as if something has been lost rather than stolen I don't see how it is a criminal matter or anything to do with the police. It is just a hoop that insurance companies make claimants jump through.
  • If in the terms and conditions it says report to police within 24 hours and op can check his/her policy, then no matter what it will be refused as frustrating as it is for op.
