    I/we were after some advise..... My mrs knew she may lose out on the refund/credit note or whatever by disposing of the wellies which is why we took pics (which are time stamped with time/date just like the till receipt). Any sort of refund/credit not etc would have been a bonus.

    @geordieracer.. you need to get out more mate. Wellies are designed for stuff like muddy farms,building sites and wet beaches, and as for dancing in wellies, could you dance in 3" of sticky mud??     @shaun from south africa. The exif info on a pic is like the id3tag on an mp3 although I guess there is something on the web to allow you to doctor it for your own needs. Your pic clearly has been photoshopped with the date imposed on top of it ;)

    I have no idea what you tried to insert there but thanks anyway. I know what wellies are designed for but yet you missed my point completely - which was if i was a retailer and someone had bought some wellies off me and then came back with them and declared they had been to a festival and got ruined i would implore them to take me to the small claims and prove they were faulty.

    festivals are an uncertain and you would have a hard job convincing a judge to state that they were faulty and you didnt just ruin them whilst at the festival.

    THAT was my point. Not wanting other folks' thanks.

    Geordie. Good job your not a shopkeeper then. Are you implying i/we are trying to defraud said shops? I asked for some advice on what/how to proceed with faulty goods that were bought and disposed of. A simple "not a chance without them" would have been enough. I'll leave it there.

    The photos prove the state of a pair of boots which could be any pair.
    As for the image data showing the date of the photo.
    Here's a photo I took a few minutes ago. (well, that what the time and date stamp state)

    As clever as you may think that is, I was referring to the inbuilt time stamp on the image data which is included within the data of a photo, including all the photo information, such as date, time, camera used, ISO settings etc etc...

    they aren't dark brown with yellow dogs on are they?

    If they are they are really poor quality China cheapies - the other half has them and they wore out REALLY quickly for a pair of wellies, making the sole slick in no time - ironically she also bought a pair of their wellibobs and they are spot on, lasting way longer and much more resistent to wear.

    EXIF timestamp is meaningless - if you change the date on your camera, it changes too! And the header info can be tweaked with a hex editor. Just for info really.

    As for the wellies vs car, I know I picked an extreme example, but that was deliberate...where is the line? What makes it ok in one case and not in the other? Would it have been different if the boots were leather? Hand-stitched leather? As laws and rules don't generally make distinctions about value, these extreme cases he'll as a mental exercise to clarify the position!

    If a product is faulty, you're entitled to either a repair, replacement or refund (the choice is that of the shop you bought them from). However, in all three of these options, you will need to return the wellies, and a photograph is not sufficient.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    But if the buyer took you to the small claims court, you as the retailer would have to prove that the boots were not faulty. (this is providing it was within 6 months of purchase).

    The Sale of goods act is quite specific on this point.
    If anything has a fault within the first 6 months after purchase, it is assumed that that fault was there at the time the goods were sold and it is up to the seller to prove that this was not the case.
