My Aviva policy says under exclusions:

We will not withdraw this cover,
i. While your car is in the custody or control of;
a member of the motor trade for the purposes of maintenance or repair, or

Is this a high value car? With the huge excesses levied plus public embarassment and potential negative affect on business, I'm surprised the dopey garage didn't try to keep it away from insurance/police.0

Most Motor Trade policies will exclude theft of vehicles with keys, unless violence or force is used, a few may consider deception but will probably turn it down.
The only policy (that I know of) that states how they will deal is Allianz on their Select or Headlight (for RMIF members) Select contract, ie a co-insurance of 35%, so a £10,000 car would have a £3500 excess, or whatever the policy excess is - the greater would apply. All reasonable care would still apply to the insurance settlement.
All policies have the "duty of reasonable care".
Just because it is not insured by the garage, does not mean they are not liable - please read up on Bailees duty of care, or Bailment. This could give you the edge - also if you have legal expenses built in to your car insurance, give them a call to see where you stand.0 -

Apparantly the garage has had the forms from our insurance co. but not his own and he states he's filled them in and sent them back.
It's a 3year old AstraStarting to save £2 coins again, but it is a struggle:rotfl:Not doing very well keep spending them

The telephone interview is normal..I had my car stolen off the drive way a few weeks ago....Burgled the house to find the keys...and the insurance co (Churchill) arranged for telephone interview.They then contact the police and see if the stories match
Churchill paid out on the claim quite quickly,about 3 weeks,after it was stolen.They will probably arrange for a loss adjuster to visit you to get more details of the car so that they can evaluate the pay out0
