One of the common exclusions in most policies is
I know it states that for this exclusion the keys must be in or on the car, but this may well be what the insurers state was the case.
I'm not so sure... having no expertise in the area at all, the garages negligence surely doesn't free them of any obligation to the third party i.e. the OP....
I.e. if I am drink driving and have a crash, the third party that I hit still gets paid out by my insurance (assuming I am insured) even though my insurance says they won't pay out for my car as I was drunk....
As I say, thats how I expect it would work, although quite possibly incorrectly....A big believer in karma, you get what you give :A

This does sound like an investigation by the loss prevention department.
Letting them set the attack dogs loose on the 22 year old whilst they record the call to use as evidence, well that would depend how astute the Young man is.
If its done in writing, you get a chance to look at all the questions and what relevance answers made will have on other questions answered, in other words, you get to see the script before the play.Hi, we’ve had to remove your signature. I do agree with Vax, when they call will they will be out to trip the OP up. It would be best to say something like due to work commitments your son isn't available for a telephone call that long during working hours so it would be far easier for them to write to you with all the questions. There is no reason why they couldn't use email either. If you do go down the written/email route make sure you keep copies of everything sent and received. If you have no option but to do this over the telephone then also try and record it yourself aswell, but make sure you let the caller know you are also taking a recording of the call for your own benefit.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0

I would say its probably best that you do not agree to a recorded interview, as clearly you cannot trust the insurance company. In the unlikely event that you have to sue your own insurers, you do not want them having any recorded evidence to refer to at a later date in court.0

How many times is this going to keep coming up in this thread?
The son was down as the MAIN driver on the policy, not the named driver. They are not fronting!
What they are doing is entirely legitimate, the car is owned by the father who is also the registered keeper, the father has taken out a policy and stated clearly that his son is to be the main user of the car.
FWIW: I'd pursue a claim directly with the garage and their insurance if possible, same as I would advise for any claim where there is a 3rd party who is clearly at fault.
Even if the garage's insurance wont pay out because the keys were unsecured and unattended they are still responsible as this is clear evidence of negligence on the part of the garage so they will have to pay out from their own profits.0 -
