    I never said it was, I am saying the insurance companies are looking for an excuse not to pay out, it is what they do.
    They just dont wave a wand and pay out golden cheques in cases where there is nobody else to get the money back from.
    They get the nit comb out and rake over every inch and see if anything drops out they can use as an excuse.
    It may be so that all insurance is correct and in place, so in such case you have no reason to hold a 1 hour recorded evidential interview for them to look for a loose thread to pull.
    You can communicate in writing and consider your answers without been put on the spot.
    Make no mistake, this is a "total" loss claim and both insurers will be looking to not pay out.

    Sorry, I misread your earlier post.

    I agree with what you are saying about the insurers. This could turn into a long ugly battle with both companies trying to evade responsibility, and it won't help matters if they claim that the garage was negligent by not securing the keys somewhere safe.

    I do understand where you are coming from here.

    However if the insurer is looking to get out they should be named and shamed so we can avoid them. Perhaps the OP could tell us who the insurer is and let us know how it goes.

    That's not really possible as any insurance company will avoid paying out if at all possible.
    If any item or service (whether it's car insurance, holiday/travel insurance etc) is covered by more than one policy as in this case, there will always be a set to between the insurers to decide who pays out what percentage of the claim.

    They can be real pains on total loss claims, they do have loss prevention departments which look to avoid payouts by any excuse possible.
    As the question on the "phone interview" will for part of the evidence, it is a good idea to have the questions in writing.
    The OP has done right to ask as now they have the heads up on what may going on.

    Logic would suggest the garage has been negligent and therefore they should be paying out themselves, or their insurers. The wording of their insurance is the key as it may not cover them against their own negligence however.

    Logic and insurance companies/the law don't always go together though!

    The fact that the son is the main driver of the car and it is insured in the fathers name has had no bearing on the car being stolen and as such should have no effect on the claim. If they try to suggest otherwise get the insurance omnibusman involved.

    I think they might have a case if the car was crashed while being driven by your son. Best to get him his own insurance and start building up a no claims. Just tell your son only to answer questions relevent to the car being stolen.

    Things like "how often do you drive the car?" have nothing to do with it being stolen. I would imagin the insurer just want to make sure he dropped the car off and went back to pick it up. Can't see how it is going to take an hour though!

    But WHY? This has already been declared by the sounds of it, and the insurer accepted the policy....
