    We thought we was just notifying our insurance that the car was stolen and we had every intention of going through garage insurance, we didn't realise this was all going to happen.     the OP has done everything they shouild have with regard to taking out the policy.

    some insurers require the RK to be the POLICY HOLDER, in this case it is and done correctly, then as the dad is not the main driver and son is they have told the insurers this, wich is perfectly legal and the MAIN DRIVER earns a NCB, dad has now fallen back into NAMED DRIVER STATUS as he isnt the MAIN driver of the vehicle.

    Quick update

    Garage insurance company still 'investigating' and 6-8 wks suddenly need more info or copies/originals of paperwork.

    I have just sent them an e-mail asking why they didn't ask for ALL the paperwork at the same time and that I would send the original V5 rec del andI wanted it returned by the same method. I also said I was going to seek legal advice as to the amount of time their investigation was taking and that I thought they were using delaying tactics.

    They now want the orig V5 and purchase receipt. They won't give any indication of when the claim will be settled and I don't know what to do now. We canc our ins. Would we still be able to use the legal that we took with the policy.

    Just wondering if anyone had any advice on what approach we could take now. Thanks

    I would not send them the original V5 and purchase receipt, copies should be more than acceptable.

    As for your insurance, I doubt they will want to know now as you have no policy with them unless they were dealing with it prior to cancelling but even then as you have cancelled the policy they still may have no interest. Might be time to seek some proper legal advice.
    Everyones opinion is the most important.....no wonder nothing is ever agreed on.

    Yes speak to the ombudsman. Usually a threat of their intervention will get things moving like a laxative.

    I agree with Pitkin and i would of been taking proper legal advice with the view of suing the garage for the market value of the car plus interest by now.

    FOS won't be interested, they only deal with cases where you are claiming from your own insurance and then only when you have exhausted the insurance company complaints procedure.

    I think after this time I’d be seeing a solicitor with a view to court action (or DIY)

    If you want to take this further, court proceedings are the correct avenue, so you might want to take some legal advice. The option of the Ombudsman is not open to you if your complaint is against someone else's insurer.

    They're only a small garage and wouldn't budge just said claim of their insurance:(
