    Stand your ground. A customer IS NOT expected BY LAW to have to study all relevant pricing indicators to establish the real price. If you the SEL says 250G in BIG letters, you're on shaky ground, but most don't and because the shelf was clearly stacked totally wrong, this is a misleading price indicator that's illegal. As such, there is little valid arguement that the DTD can't be applied.

    Went in my Tesco this morning and bought some Tesco 250g 'Joseph Heler' cheese (about 5 different varieties).They are marked up as £1.39 each or 2 for £2.00 but at the till both were charged at £1.39 each.Went to CS and got refund of £1.56.

    I had a very similar case a while ago (actually this was in the old R&R days). Two similar products, one SEL under the wrong product, and no second product anywhere to be seen. The CS were adamant R&R didn't apply, and so was the idiot duty manager, so I phoned Dundee who were lovely and said it was misleading if it was just the one product and just the one SEL, and gave me my money back.

    It amazes me that some staff will fight like this over the sake of a couple of quid, instead of just letting go and have a happy customer as a result. :rolleyes:

    HI, thanks for the advice..i guess i didnt want to be seen as being 'uppety' myself over the sake of a quid,...they did refund me the the £1...so were happy to let me have the blackberries for£1.99 instead of the £2.99 which is what they should have been, (thier fault they had no correct price)..but was concerned of whether or not i should have insisted on getting £2 refunded as part of there DTD policy,...thought i would ceck it out on this thread with all ure 'specialist' knowledge before i go making a idiot of myself!

    oh by the way do you have the tel number for dundee...might be worth keeping on my mobile incase of any future incidents where im feeling bold and thrashful! heehee:beer:

    This was amlmost exactly the same situation for me when I got my (first !) Xbox 360. SEL was for the 360 alone, however the shelf only had the 360 with game bundle box. The fools had forgotten to put all the empty 360 boxes out.

    So, heart in mouth I took the DVD box to the till and paid the higher price.

    Oh how they fought !!! Dept. Manager, floor manager, store manager all said "No !" (Cashier agreed with me, although she wouldn`t admit it in front of her boss) Loooong call to Dundee (on their phone, BTW), who then called the Store Manager and over-rode him on it. He wouldn`t come down to the shop floor to authorise it, but you should have seen the faces when the floor manager came along and refunded me. :T

    Took about 45 minutes all in, and worth every minute.

    And it seems like Tesco continue with their over-charging exploits, however it`s only worth bothering with a few nowadays.

    At last I can share a mis-price with you - Instore today the Youngs Scampi in the special offers cabinet of the frozen foods is showing as the SEL £1.99, however it is scanning at £3.99. Quite a good double the difference - £4 refunded!!!
