I think you are stuffed.
I can't think of any other constructive advice - perhaps take the bank statement to the store to prove you were charged twice and refunded once?

Its the fact that she accused me of tampering with the labels that gets me..
Still I guess £65 for all the phones, games, booze, meat etc, ive had since i started R&Ring a couple of months ago is quite a bargain0 -

On the 1st of December during the moet overcharge i purchased 6 bottles, blatant overcharge despite the manager and her minions disappearing off several chats lasting 5-10 minutes i eventually got my full refund or so i thought. however i pointed out to the CSA that she had ballsed it up and debited my card a second time instead of crediting, she then said she had overridden the payment so i pointed out that i was still owed a refund for the original overcharge, which she then did with some persuasion from me.
Being a bit suspicious I asked for copies of all the reciepts for my records this she refused saying due to the errors she would need all of them, i insisted that i was entitled to them however she still said no and given the length of time that had passed i agreed only if she would let me take photos of the receipts which she did.
I thought something was fishy so called my card company when i got back to work but they said no credit payments would show for a few days and that i should call back then or wait for my statement, which is did.
The statement arrived this week and showed two debits of 95.xx each and only one credit of 131.xx (i presume this refund obviously forgot to subtract the 25% off 6 bottles) so i am still £65. out of pocket.
I called the store and spoke to the manager who said she would call me back later in the day having given her the details from the bottom of the receipt.
The next day she called and explained that she agreed there had been a mix up, however she had reviewed the cctv footage and apparently five minutes before i made my purchase someone was seen "tampering" with the SEL and that i had also done the same thing in another store earlier that day (this was true well the R&R bit not the label tampering - although i used seperate cards - are they allowed to swap info on customers like this?) and would not be refunding me because of this and said if i wished to take it any further i should call head office, which i did, they told me to discuss it with her and if she said no then i was to ask for her regional manager.
So i called her and she refused to give me the name or number of the regional manager saying she wasnt allowed and that she had nothing further to say and would not be discussing this matter further......:mad:

contacting the cc I think that would be a good idea and ring c/s dundee asking to speak to someone more senior then put your complaint in writing to dundee and the legal dept at the proper head office I think at chestnut this sounds like fraud decieving you that you were going to get a refund.
but this would make them aware of you something most people avoid but hey you would maybe find it difficult to R&R in this store again if they are accussing you of fraud0 -

Thats the best way to look at it I think.
You could go to them and ask for proof of their accusations and ask how they knew you had R&Rd in another store that day. You could even go down the route of an Subject access request under the DPA, its all down to how you wanna play it.
Like you said, £65, although hard to stomach right now, is nothing compared to what most of us have got over the time.
I think in your circumstances I'd bite the bullet on this one and live to fight the good fight, that plasma/Xbox/wii/PS3 could be just around the corner!Missing Tesco R&R since Feb '07 :A & now a "Tesco veteran" apparently!0 -

We had Sky TV installed this morning, gave the guy that installed it a case of Kronenbourg seeing as its Christmas and everything!
He did mention he reads this site but hasnt tried R&Ring yet.

This is a lesson that highlights if you are going to r&r you shouldn't use debit or credit cards. It certainly appears that this is how you have been tracked down and it must have taken a bit of digging on their part to achieve this.
As you had previously r&r'd the same offer from another store, Tesco will most likely argue that you already had prior knowledge of the overcharge and were taking advantage of the policy, although this in no way excuses them from the fact that they were breaking the law by overcharging.
The 'prior knowledge' argument in fact may not hold much water as it's their mistake, not yours, and you were simply entering into the buyer/seller contract. The reason I say this is because they have mentioned someone had 'tampered' with the SEL. It does seem slightly coincidental that they are claiming this happened a few minutes before you were on the scene. I would be very suspicious of this claim and can certainly imagine if the store wanted to provide justification to absolve themselves of blame then this is a relatively easy manner in which to do so. The only way to be sure would be to see the footage for yourself.
Having said all that, you have already flagged yourself up to Head Office and raised your profile quite significantly. Although you can push things through and complain, it's quite clear that Tesco can close ranks and make life very difficult for you in the future.
If I were you I'd walk away from it and live to fight another day.0
