That is a decent amount for a minor rtc. how is completely writing off my car and being in pain for 18 months minor?

As far as the value of your car i am surprised you even got that for a 7 yr old meriva with high miles. It would go for £1000 less at auction and is not the most popular on the used market, possibly unfairly as it is a decent family runaround, but used car values are fickle things, you do realise that your car was worth under £6000 when it was three years old don't you?not overly pleasent are you?
would you be be pleasant if you had asked a genuine question to be mocked and replies full of sexual innuendo?

Having reread your OP, I see that the third party was uninsured and so you will be getting paid by the CICB which have a fixed amount depending on the cause/injury. you can find more info at:-

no i did not nor is that what i want. Read my original post. I stated that the amount of £4000 is what my solicitor says we should ask for. Iwanted to know if that was a fair amount considering how much pain i have been in since jan 2010. The only thing i want out of this is to treat my long suffering family to a decent holiday.

If you stopped being an arogant and abusive *** for a second you will see that I have already told you that your payout is reasonable, with the standard whiplash compo being an industry standard £1500/1800, so you have been offered or advosed to accept an offer of around £4000, whicih is twice what the industry norm is.
You obviously have no idea how the personal injury system works, there are set amounts for everything, if you go to court then the barrister and the lawyers also have a list of the usual accepted amounts for various levels of injury.
I don't know why I am even bothering to post on YOUR thread as you are not listening to anything that you are being told, you seem to think that you are entitled to smething more than the sum offered so you must know more than anybody on here and your lawyer.
I advise you to sack your lawyer and take the other party to court yourself.
You seem unable to understand the concept of a cars resale or trade value and difference between this and your percieved personal value that you place on the same car, they aren't the same.
I can assure you of one think you have no concept of long term chronic pain.

Nonsense, in cases involving an uninsured driver the claim is paid either by the MIB or by the car owners insurance company under (I think) s151 of the RTA.
Generally the courts tend to use the JSB guidelines as an aid to valuing injuries, your solicitors will have access to this which, together with your medical report, will enable them to properly advise you. They should also advise you that if the other party makes a pre trial offer (aka part 36?) which you reject and the court subsequently award you less then you can become liable for the opposition costs from the point the offer was made
Be guided by your solicitors but on the face of it and given the injuries/recovery you've described £4k does seems on the low side0 -

The OP does not have whiplash, she has a lower back injury, which would attract a higher award. The figure I quoted earlier (probably lost in amongst all the nonsense about her username) was taken from the JSB Guidelines 10th edition.
£4,000 is on the low side, but it's hard to be accurate about what the OP should/will get without knowing the contents of the medical report. In her shoes I would be pushing for at least £5,000.0 -
One problem with the claim is the pre-existing condition mentioned in the OP, how much of the pain and injury is due to or attributable to the operation the OP had on their spine in 2006?0
