Is this amount fair?

Sorry a brief history. In Jan 2010 whilst we had the horrendous snow I had a car accident. I was driving on my side of the road and was met head on in a collision and then her car slid into the drivers side trapping me in the car.

I panicked cause the airbag had gone off and I thought the car was on fire (totally stupid idea i now know) and kicked my way out on the passenger side. Anyway police and ambulances were called. It turns out that she had sped up to take a turning to her right before I passed and the car slipped. I was very shaken and upset at the time as the whole front of my car was smashed in (Vauxhall Meriva) I thought I had only injured my right elbow as had smacked it really hard on the door. Hospital discharged me that night with soft tissue injury.

The following day I could not get out of bed as I hurt so much, my neck and back were stiff and very painful, along with my elbow. The the police called to say unfortunately the lady had no car insurance.

Thankfully we were fully comp with Tesco. So they (eventually) sent us a cheque for £3400 as they said this was all our car, that we'd had straight of the forecourt in 2004, was worth due to the high mileage. It had cost us £14,000 new.We'd just spent an absolute fortune the month before on new brake pads, wheels service. We shopped around for a car and the only thing we could get was £4900 so already majorly out of pocket.

I had to go to GP several times over the next few weeks as was still in pain (still am 18 mths later) I was then refered to an orthopedic consultant who I had seen before as had a spinal op in 2006.

Because of the legal cover on my car insurance Tesco recommended a firm of solicitors to take on my case. So here we are 18 mths later and currently doing physio after a Caudal Epidural in january. I went back to work after a week as I only do 20 hours a week as a receptionist as could not afford to not work.

The last yr and a half have been horrible for my family. Days where I couldnt do much, trips out were I cant participate. That and my grumpiess sometimes from pain, My boys are 16, 8 and 2. Husband has taken a lot of household chores.

Since the epidural I am doing a lot better. Plus the physio is helping. I still get days were the pain is bad but its manageable.

I got the medical report back today and the specialist says I should be healed within 21 to 24 months from the accident. The solicitors in their covering letter have said that in light of the report that they can now persue a claim as they are going after the car owner and not the driver as she had permission to drive it. The other side have already admitted liability. They are looking at between £4000 and £4750. Their own fees have hit nearly £10,000!!!

Does this amount of £4000 seem fair? I do not want to be greedy. In fact all I want is to be able to take my family on the trip of a lifetime to Disneyland florida to say thank you for putting up with me and for helping me through the last horrendous 18mths.

    Solicitors will always get more than the injured party. I had an injury claim and eventually had a defence AND prosecution solicitor ( too complicated to explain here) The prosecution solicitor had been working on the case for 3 1/2 years in the end and the defence one for about 3 months. Other parties case against me went to court first. I won hence no need for my case to be heard. Defence solicitors got 5k....God knows what the prosecution got.

    When the solicitor advises you to accept 4-4500 or whatever , he is only making a recommendation. you still have the right to insist it goes to court to see if you can get more. The judge will know what you have been offered and could well offer less. You also have the right to delay things until after the 24 months the doctor said you should be fully healed. if you're still suffering after that length of time, i would think your claim would increase significantly...but no doubt you just want the whole thing over and done with.

    Also the figures they are giving you do indeed seem low, but obviously is all about conjecture and opinion.

    £4000 sounds too cheap to me you would get £1800 just for lodging a claim

    Seems low for what you've described.
