How would you feel if it were a "money for money" case? By which I mean, what if she had LENT me £100. Then I'd worked for her and earned the £330, and she'd refused to pay me.

Would it then be OK for me to refuse to repay the £100?

Whilst I appreciate your situation, that analogy is not the same. Regardless of how you came by the mags, you did not have permission to sell them. This is taking the law into your own hands and is illegal.

In your analogy, she could sue you for the £100 and you could counterclaim. The court would in most likelihood side with you, and this would also be a civil case. But by selling her property, you are selling goods which don't belong to you - a criminal matter.

I guess if possession is 9/10ths of the law, then the mags were in your possession, and for such considerable time before a return request was submitted, it doesn't seem unreasonable to assume ownership.

I would stick to the truth that you sold them (there might even be a record in ebay?) but I would have thought she meant you to have them as payment, you say she didn't give you any cash in after selling the compy, but she had agreed to pay you? I imagine there was also a risk you wouldn't get anything, if the compy had sold for less than £800?

If selling something for someone else in the future, I'd use your own paypal/ebay account then forward on the money, then you won't lose out. Maybe saying how dissapointed you are that she's going back on her word but offering to split the extra money at the time would have had worked out better all round. (hind sight is a wonderful thing lol)

I would just ignore her. she can't prove anything - it will be her just desserts for treating you so shabbily.

She wants her magazines back, not what they were worth years ago.
As it was several years ao, if you mean should you pay her the £100 you sold them for then, what if they are worth a lot more now?
For example, "The Green Lantern" wasn't worth much then. It's worth a lot more if you sell it today now the films out.

I appear to be alone here, but taking £330 off a mate for 3 to 4 hours ebaying does seem a bit excessive. They wouldn't be a mate anymore if someone took that much off me, especially if I didn't kmow what the item was actually worth in the first place.

Yes, but as I no longer have them, I cannot do that, all I can do is give her the money I got for selling them.
