For what it is worth, I would never, lend people books or magazines, unless you can take on the risk of not getting them back. If you want to take the risk, then put your name on them and even then you have to accept that you might not get them back.

I suppose the same goes with anything you lend, but it seems that books seem to be a special case as they are notorious for going missing, even if you lend them to the most honest of people.

I havent read the whole thread but i'm surprised it took a long time before someone actually said you are no better than her.

You did her a favour in the hopes of a few extra pounds, would you have done it even if she didnt offer you to keep the extras? most probably and whilst she never fulfilled her half ( and it was unfair that she broke her promise) you had no right to go on and sell her magazines without her permission for your gain.

Do you not feel a little guilty for doing that? Like others have said its stealing!

edit- read a bit of the thread and i do feel bad that you have been put out and she does seem like nast old bag you still shouldnt have sold her stuff.

I found there is maybe a defence for keeping the items depending if the OP had a valid lien over the items arising from ancient custom and usage. I think it may depend on what ye olde ebay sellers were doing back in 1866.

I think this is the wrong case for the OP and legal advice would be needed. A more general discussion of liens may be found here which quotes the above case:

To save reading the above links here is the important bit:

The right of a skilled workman to claim a legal lien will normally be given by an express contract term. In the absence of such a contract term the right to claim a lien may only arise from custom and usage, where the right to claim a lien is so universally agreed within a trade (e.g. warehousemen) that everyone could be expected to know of it or easily find out (Re Plaice v Allcock (1866) 4 F.F. 1074).

I do not think it applies to the OP but the information is interesting nevertheless.

I would just tell her you couldnt pay your gas/leccy bill so you burnt the magazines to keep warm;)
If she says you're taking the p155 - tell her she started it;)
(But if she really wants replacement copies she could always try eBay):D
