    This is ALL old hat. Don't waste time sending polite requests. Send a LBA demanding they pay within (say) 14 days as your claim was valid according to the t&c and received within the 60 days allowed and informing them that should it not be paid by then you will immediately commence legal proceedings - in which case you will also claim all court and incidental costs plus statutory interest. Send it to cpw t/a E2Save.

    This is a VERY well worn (and successful) path and the only language cpw understands once they start playing games.

    Just to be clear; it will NOT affect future claims.

    Actually, mj is right - go via LBA asap as there is a breach of contract.
    You could do both (LBA and email) as it would do no harm.

    They just need to be pushed and it will be paid. I wonder how many just accept what they say though??
    TBH, there can't be many in this situaution (exactly 60 days).

    Guys, don't presume that everyone is as knowledgeable as you in legal matters.

    LBA = Letter before Action

    No update of final result, but I'm pretty sure they got their cash. Or was there another similar issue??
    It was with Buymobilephones (BMP's) last time.

    There was another one with mobiles.co.uk ...exactly the same it was refused del on a Saturday and they claimed it was out of time will try and find it later on.

    Found it ....

    Whats interesting is that if they wish to not accept on a Saturday then theres a case for claiming for 60 working days esp if the 60th day when del was attempted falls on a Saturday
    It's not just about the money

    thanks for your advice guys, going to incorparate a LBA into this too. Hate being ripped off. If it was delivered on the 24th March, I wouldnt have bothered but now the situation is clear cut.

    And why dont they accept it on Saturday, the whole nation gets post on saturdays??

    Learn from the mistakes of others - you won't live long enough to make them all yourself.

    Whole nation? Are you saying that all companies have someone in place to sign for the recorded post?
