I have had enough of HSBC refusing to accept the fact that as i am on benefits and recently seperated among other things, i am a genuine case of hardship. They are not interested, so i am filing with MCOL.Ive read here somewhere that as i am on benefit i dont have to pay?Do i complete the claim form the normal way, will it have the option at the end to state i am on benefits, or do i have to do it another way?? dont want to go all the way through it to find out out i have to complete a different form if on benefits. Also should i state at the begining/top that this case is not eligable for a stay etc etc as its a genuine hardship case??thanksi also had reply from barclaycard today saying their offer of half my charges (366.00) is their final offer, so looks like i will have to do the same with them>0

As you are on benefits you will be entitled to Fee Exemption. However as I am not sure having never used it if you can use MCOL in these circumstances I would advise issuing in person at your local court. On the stay question you should not mention the stay at all it will be issued in the normal way and it is for the court to decide after it has been issued and an applcation is made whether to stay it.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
