Court fee exemption if on benefits

  • Thank you Nickmack, Ive looked at that and I dont think we're exempt bu we may be able to apply for remission on hardship grounds. Downloaded the form getting on wioth that today. Do you know if its worth giving the bank a ring before i go through all this and asking if they have dealt with my claim yet, it could be in the post in the next few days and then i wouldnt have had to go through all this. Comments on this would be appreciated from anyone

    hi all im off to northampton court today to set the wheels in motion, i will take my benifits proof up but what else do i need to take as american express aint in northmpton? help please

    You need to fill in three copies of form N1, and provide three copies of anything else you are sending in with it (schedule of charges etc).

    Probably better to go to the court. Pick up 4 copies of N1, and take them home to fill in. I can't remember if I've posted a guide for this form or not, I can do this later if you need it (all the wording etc). Ask the court at the same time if your proof of benefits is sufficient.

    can you get legal add for court fees against banks?
    ive seen some very small amounts of money owed £30-£75 and have heard people having to pay alot of money just to file a small claim £100 up..
    reason i asking is im on benerfits £37 a week and cant afford to lose more money to barclays, ive worked out im owed about £550 how much do i need for court fees for this amount-ish?.
    thanks in advance for any help or advice given

    You can apply for exemption from fees if you are on certain benefits and other conditions apply to levels of income. See here for more information on that :

    I assume you get Income Support so no cost there then .

    I'll post this for others information who may read this post and have the same question. If you are eligible to pay however there are further details as to how much you may pay here :

    (in your case of £550 this would be £80)

    The only additional standard cost is that of the Allocation Questionnaire which becomes neccessary if the bank file a defence. You will pay £100 if your claim exceeds £1500 prior to addition of court costs, which if you pay you will be awarded back on judgement in your favour.

    (in your case you wont pay this)

    In conclusion it wont cost you personally anything at all so go for it and good luck :)

    dont be affraid of the small claims court i took my mobile phone to the small claims court but they payed me back 2 days before court date .so dont be put off the people in the court can help u if u find it a struggle to fill in the forms .im going to take my bank to court as they are being total s""ts to me and if u on benefits u done have to pay as i didnt coz im on wftc &ctc
