Court fee exemption if on benefits

    Am getting to the end of 2nd letter stage...then I'll have to go to MCOL. Can anyone tell me if there is a part in the form that exempts me from paying the fee....which for me would be £120....as I'm on benefits? I believe it is form ex160. Would appreciate any help you could offer!!! :D

    I am new to this and this is my first post. I am trying to claim from the Natwest - without much success. I have sent them 2 letters at 14 day intervals asking for them to refund me £2,000. I have received no response to either letter. I have have emailed Customer Relations twice and faxed the letters through to my branch on Friday. It is now 30 days since my first letter and so the time is up to begin court proceedings. Problem is that I can't afford the £120 fee. Can I write to the FSA or any other financial body or is court the only way forward? These charges have been applied to my account over the last few months and snowballed so I am broke!

    Should you be on benefits, you do not have to pay court fees, but cannot file online either (you will have to go to the court with the papers that prove you are excempt). If you are not on benefits just broke - is there anyone that could lend you the money for the time being? You will get it back from the bank anyway. If that's not an option, you could contact the Financial Ombudsman. They take on your claim for free, but it will take much longer than any court case would.

    just to let others know - it is possible to pay online using MCOL. then claim the fees back if you are exempt. When i filled in the exempt form at the court, there was a section asking if you are claiming a refund for fees already paid. MCOL confirmed this.
  • I have sent all the letters to Nationwide about reclaiming my bank charges but they refuse to refund them. I am at the point where i need to take them to court but I cannot afford the court costs becasue I am only on benifits. Is there anything i can do????:
  • I started the ball rolling March 10th this year and received the standard we're sorry you've had cause to complain letter.
    Today I got a two page letter saying the charges were lawful etc, which I expected, but...I have just looked on the Moneyclaim site to claim against them but the charges will be £120 for the £2441.14 Abbey owe me. I'm a single parent on benefit and that is all I get per fortnight, I need to get these charges back but how can I without taking them to court?

    HELP!!!!!

    Hi,

    I was just wondering if anyone would know if I was exempt from court fees? I am not on benefits but am a student and have a part time job. I don't think I am, we students always get shafted lol, but I thought I'd better check.

    I have tried to access the hm courts links myself several times today but the page doesn't load, it keeps timing out. I notice the mcol site is running very slowly as well - a lot of people must be launching claims!
