Unfair parking enforcement....clamping

I was recently clamped by a company called park direct. I feel this was done unlawfully as the clamp was not placed on my car until I was stoodin front of it. The clamper block my car in so I could not move it. Charged me £375.00, which he said was a break down of £250.00 for a call out and £125.00 for the clamp. I asked if had been called out and he said NO, so why the £250.00. After I paid him I asked what would now happene? He said don't worry I'll wait with you. So thinking he was going to call some one to say that I had paid. He didn't, he just took the same key he had locked the clamp with 2mins previous and unlocked it. There are no easily readable signs as placed way too high and the area does not state where too or not too park. Speaking to other people who have been victims of theses people, it seems that their tacktic is to wait till you leave your car, even if it's for 1min. The block you in by imprisoning your vehicle. This way they have time to clamp you. As stated on their invoice you have to appeal within 10 days, which I have done 2 times also recording and special delivery of my letter but guess what they say they've never received any. I am now going to follow up with a third copy of mug original letter stating that I am now going to proceed with court action. Has anyone out there had to deal with this cow boy company or had a similar situation, if so all information would be appreciated.

    Many people now know they can safely ignore private parking tickets, so I expect landlords will resort increasingly to clamping, at least while it remains legal.

    Or not positively illegal.

    I've ignored two of these tickets at service stations, but were I the owner of a patch of ground that was being parked on, and were I bothered about it, I would use clamps.

    Eh? How could where you were standing at the time the car was clamped be of any relevance whatsoever?

    It may be relevant for clampers on public roads. I remember a documentary about London council-approved towers and one admitted on camera that he shouldn't have towed the previous vehicle because the owner had returned before the car's wheels had left the ground, but he had carried on anyway! No idea whether it's relevant on private land.

    Anyone know when clamping will be outlawed? I thought it was April this year but still seems to be going on; just seems like legalised extortion as you have to pay up or lose your car and the charges are rediculous for a minor parking infringement. Sooner it is banned the better.

    I don't think it has passed the the committee stages yet. I think you are probably looking at the next parliament for this one. It is included in another bill, far bigger than this one issue.

    Yep happened to my wife.

    It was on land that for years had been the parking/service area behind shops that had been used, by the public,without any problems.

    Freeholder sold off the parking places, that week and bang. Warning signs were poor and non existent.

    Wife and another lady drove on, enforcement vehicle, big plain clothes 4 X 4 blocked them in, no warning, clamps on end of story.

    Police and local council on site at the time. Nothing could be done. Loads of complaints to press etc.

    Only saving grace the council were going to introduce parking fees on their council land, in the end they didn't or haven't yet, nobody parks on the affected car park any more so bit of a dead duck for now.

    We could have appealed, guess which bin it would have gone in? Who do you think you are appealing to? Can't really see a court being interested.

    Hardly a dead duck, it seems to have had the desired effect. If no one parks there, I'd say the signs were adequate, or people would park on there.

    Signs were upgraded after this event.

    What is the point of having an empty car park?

    If they had simply wanted an empty car park they could have put the barrier across and locked it. Giving a key to those that they might want to use it.

    It is a fully surfaced car park that isn't a bomb site awaiting redevelopment. It will not get planning permission for anything else.

    There is ample free car parking at present.
