I doubt the car is totally dead it could be fixed but whether or not you could get shell to actually pay for the whole thing is a different matter. How have you spoken to them so far, phone, letter or email?? I would only deal with them via email or recorded letter. Maybe a letter from the garage outling the reason for the turbo failure too sent as a copy to shell along with the receipt from the day you bought the oil. Then just explain that you were sold oil when your car clearly didn't need it, being of a non mechanical nature (regardless if you are or not) you always take your car to a garage for such things but expected the attendant who was acting on behalf of shell to be qualified enough to knw what he/she was doing and not to overfill the car causing so much damage. Finish it with the bill for the repair, the cost of oil (cheeky but may aswell) plus any costs you have incurred like travel expenses because you haven't had your car. You may not get it all but a good proportion would help.
Other than that it would be worth seeking legal advice and get it chased that way

the quote for the turbo was £1000 (just the turbo!!!), after speaking to my own insurance company they suspected that the vehicle would be written off as the repair bill would be to high. so far i have only spoke to someone on the phone to put my complaint in, and they said all correspondence would be by letter.0 -
Flaming hell, everybody reading this, DO NOT check your oil unless your car has been sitting for 10 mins until the oil drains back into the sump otherwise your dipstick will not give you a true reflection of the oil level in the car.

Your insurance company probably would write it off as it would be then that has to pay for the extras that make it infeasible to repair, shell might not be so lucky and may have to stump up for the repair plus the other costs like hire car etc.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0 -
I would say the liability lies with shell.
They checked and topped up your oil, if the person doing this wasn't 100% sure what they were doing, it shouldn't of been done.
You hadn't touched that part of the car and although you seemed ok with it... does that mean when you send a car in for repairs and the bodyshop mess up, your to blame for saying 'yes you can repair my car?'
Get on to shell and file a claim for the damage.0 -
I worked the petrol pumps as a schoolboy in the 60's, managed to check oil ok then, mind you it wasn't such a technical job as modern cars seem to be, double dip indeed, heard it all now.
Where is this marvellous garage please, must be worth going there for the trip down memory lane, was he in a boiler suit or sporting a smock, and did he doff his cap or if capless knuckle his forelock, triple green shield stamps and some free tumblers sir?

What a crazy story. Pull into a garage and an attendant comes running out, tells you to pop the bonnet and checks the oil. I've never heard of something like this happening.
Personally I'd have told them to jog on if it had been me, it's obvious the cheeky sods just want to sell you something and aren't doing it out of the goodness of their heart or a genuine concern for the mechanical welfare of your car.:cool:0 -
i reckon liability lies with shell.
i'd obtain a report from the garage, detailing the failures and cause and cost, with the oil reciept send a recorded letter, also requesting the CCTV footage of him checking it and filling it (they dont have to obtain from that garage either as their server based cctv camera's and all footage can be accessed from thier end) and demand full payment plus additional expenses wich will be forwarded when the vehicle is repaired and returned.
no one checks a dipstick when cold anyway the oil is thinner and is still settling in the engine and will allways give a false reading.0 -
They were offering this "service" at my local Shell a few weeks ago, I declined the offer as I thought it seemed a bit suspect.
If the attendant topped the oil up and it's on CCTV then you're sorted OP.:A0 -
