petrol station forecourt mistakes

on the 15th of may 2011 i visited a shell petrol station to fill up my beloved landrover freelander with diesel and was immediately confronted by an attendant wanting to check my oil and windscreen washer levels. i agreed to an oil check. The attendant checked my oil level, and showed me that i was low and recommended a top up. When i went in to pay for my fuel, the attendant showed me the oil i needed to purchase to top up. We then returned to my vehicle where the attendant topped up my oil. The following day on my way into work, my vehicle gave up the ghost and died.... I was then towed to a service garage where all the filters were replaced and a refill of oil. After paying £371 to get my vehicle back i was told there maybe underlying problems due to the initial overfill of oil on the forecourt. After travelling a mile away from the garage my vehicle died on me once again, and i was towed back to the garage again, and was then told my turbo was knackered due to far to much oil being put in in the first place. Where do i stand? I have been in touch with my own insurance company and shell's insurance company. I still have 6 months finance left to pay and it looks like i won't be getting my vehicle back. What would be an acceptable offer from shell?

So this attendant checked your Oil as soon as you had pulled in for Fuel. And it was showing low on the dipstick?......0

Then it would show a low level on the dipstick... Oils still draining back to the sump. All basic stuff.... I'd be talking to Shell.0

How qualified was the mechanic / attendant?
Shell do give advice for checking oil...

No idea how qualified he was, all i know is he was a shell employee offering the service to all customers and promoting shell products.0

I posted an account of a similar story here ages ago.
An old dear drives in to the local Esso filling station asking for some help in choosing oil and topping up. My mate, who at the time knew nothing about cars, picked the correct grade of oil according to her handbook but rather than check, chucked the whole lot in. A wee while late old dear's car is on the back of a recovery truck. Not sure who paid for it in the end but it was either Esso or the franchise manager of the filling station.
My mate now runs, successfully, a property management company!0 -
