    You aren't being honest with Paypal if you don't tell them that you have received the laptop, but it is stolen.

    No don't wait, as you will just cause confusion, and delay things (they don't appear to be trained to think at Paypal).

    If the police have now taken it back shouldn't you have been given documentation to that effect to send on to your card issuer?
    Personally I would phone Paypal, tell them that the tracking number is wrong & also advise that they have the reason for the chargeback wrong, ask what should happen now.

    Just had the following reply from my card issuer:
    Dear xxxxx,

    Thank you for your email.

    Please note we used the goods or services not received charge back form.
    As although you did receive the goods, you effectively did not.

    We are waiting for PayPals response.

    So should I contact PayPal or not?

    That sums up their position perfectly. You recieved something, but it was not the goods you ordered. The goods you ordered were not the sellers to sell, so you did not recieve what you ordered. Simples. They seem to have it in hand :)

    True, but they don't appear to be that inteligent at Paypal. The wording has to be exact, and explain the exact situation. So the OP should still contact Paypal to make things clear.

    Thanks, that's kind of along the lines I was thinking of.

    I know what you're saying d.ross but at the end of the day it's my card issuer that decides whether or not the Chargeback is valid, not PayPal. Additionally, the tracking information the seller supplied isn't a valid tracking number so when tracked, it shows an error so presumably when PayPal check that, they won't be able to use it as evidence because it's not valid.

    As Norfolk_Jim says, my card issuer seem to have it in hand and at least they're aware that it's been submitted as an 'Item not received' claim, which was my main concern.

    I can't understand your refusal to put paypal in the picture. If they have to collect evidence, then they will need the correct information.

    Because a) it's not my job to - The bank have a far greater knowledge and understanding of the Chargeback procedure than I do and if, knowing all of the facts, they have decided to put a particular claim in, I am not going to interfere. Besides, as Norfolk_Jim says, technically, I have not received what I paid for. And b) why should I do anything that could potentially help the scumbag that sold me a stolen laptop?

    You say it's not your job to make sure everything is in place. Yet you let loads of MSE members waste loads of their time giving you advice.

    Excuse me? What's your problem?

    I don't see what the issue is if the card issuer have purposely submitted the form that they think best. At the end of the day it's them dealing with paypal. Other than submitting the form to the card issuer (where I stated the truth), I have had no involvement and have bot been invited by paypal to comment on the case. My only option on paypal is to cancel the chargeback which I'm not willing to do.

    Sorry if you think that's wrong but no need to be such a jumped up tw*t about it.
