Unfortunately flyboy by the owners own admission he has messed with the aircon and so i assure you no court would find in his favour
Ive already said what i do for a living so can also assure and your apprentice i dont need to read up on any current laws that affect me or my business.
I can also go one step further and also tell you i use proper solicitors when needed ,who are specialists in their fields, i never use jobbing solicitors for real mens work and also once had to pay £200 an hour to a barrister to reclaim a stolen car, that was 20 years ago so trust me i do homework diligently before giving advice which is free impartial and to the point0 -
Why did the OP wait til warmer weather to see if the AirCon was working or not? Surely it would just be a case of switching it on and seeing if the car got colder, it doesn't matter if the weather is hot or cold, it is still very easy to test.
All we have is the OP's word that it wasn't working in Feb, whereas surely the garage will insist it was.
If the aircon hasn't been used for several months, this may also have added to the problem, it is suggested that you turn your aircon on for about 10 mins or so every week, just to keep the system lubricated and in full working order.
Added to the fact that the OP is a bit of a DIY mechanic and has admitted to tampering with the aircon themselves, this alone could have caused damaged to the system, having an unqualified person fiddling with it.
Personally I don't think they have any case taking the car back to the garage. Most of the problems they have highlighted are general wear and tear items and no garage would cover them on a second hand car.0 -
I don't think there is anything to be gained from the thread till the OP gives us model specific details.
Certain cars are well know for aircon problems. Ford Galaxy for example, always giving grief, rusty pipework being a regular one.0 -
I don't think it matters either because they will have invalidated any genuine claim they had when they decided to have a go at repairing the car themselves.0

Really, I missed where he wrote that, perhaps you could point it out to us. All he said is that he regassed it.and so i assure you no court would find in his favour
How could you even possibly know that?Ive already said what i do for a living so can also assure and your apprentice i dont need to read up on any current laws that affect me or my business.
No you haven't and unless it is a solicitor specialising in consumer law, or a medium, I don't think your occupation has any relevance.I can also go one step further and also tell you i use proper solicitors when needed ,who are specialists in their fields, i never use jobbing solicitors for real mens work and also once had to pay £200 an hour to a barrister to reclaim a stolen car, that was 20 years ago so trust me i do homework diligently before giving advice which is free impartial and to the point
Well you need some further study, because your assumptions are very wide of the mark here. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

It doesn't make any difference if it was working in February or not. The SOGA assumes is that the fault was present in February and it is up to the seller to prove that it wasn't.The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

How would that detract from the OP's consumer rights? If a particular model has an inherent fault, it doesn't mean that the consumer should accept the fault. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

How so? If A component has failed it could be considered reasonable to expect the buyer to remedy it. If, for example, a light bulb has blown and the buyer changed the bulb, but it still kept on blowing, would that invalidate any claim they might have? The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

Surely by accepting the vehicle sold as seen, and then not reporting any fault until 3 months down the line would be sufficient enough to suggest that there wasn't a problem when the vehicle was sold?
I think you are missing the fact the OP has also attempted to repair the aircon themselves, as pointed out earlier by s b.
Just for arguments sake where would I stand if I bought say an ipad, 3 months later the sound stopped working, so I got my screwdriver out opened it up, and oh dear the speakers are broken. I then send it back to apple protesting my rights under the SOGA, where would I stand?0 -

Depends how far down the aircon will take the temperature inside the car. Mine goes down to 12 deg C, so if the temperature outside is already colder than that the car doesn't need to have aircon working to achieve the temperature, it just uses fresh, cold air from outside. You hold your hand in front of the vents and you get cold hands whether the aircon part of the climate control is working or not.
TBH, while Aircon is nice to have, it is hardly a necessity. I think the OP can quite safely transport children in a car with no aircon without fearing a call from social services.0
