Management were involved in someway, so the problem has been taken into work in somehow.

yeah i know what you mean but i'm guessing that from how it was worded, he 'admitted' to it after he'd been dragged in and told he's being suspended.

DM - (what is a DM anyway? MD yep but i'm strugging on DM) - you're being suspended on an harassment charge!
OP - I haven't harassed her... although a few months ago one night when i was drunk I .........

Are you sure what you are being disciplined for is harrassment rather than miseuse of company emails, or spending too much time socialising rather than doing some work? I find very hard to believe that they could be considering disciplining someone without investigating the matter first, and if there is no evidence of the accusation, how can they proceed with anything?

However, if you were my employee, I certainly would have you disciplined for personal calls and misuse of emails. You were clealy more focussed on flirting than getting on with your work.

I was cleared after 5 minutes on the basis of no case to answer.

Phone and text records I provided showed an equal amount of texting and I retrieved the content of all our emails and presented those

On the Facebook incident. I recall nothing and was told by the accuser they had proof. I was incredibly drunk so took the blame and no more was said. When it came to the cut. There was no such evidence and it turned out the exact time the messages were sent I was pictured live in the crowd watching a football game.

I never ever made a personal call at work. Emails I accept were wrong but everyone uses work email for those ringround things. However, I'm the lead member of my team in terms of achieving targets so god knows what I'll be like now this is off my shoulders.

Now I'm considering a counter claim for the time I've lost out on and the mud my name was dragged through

    DM is Duty Manager btw

you're better just booting her in the under carriage and let her get on with it.
You were suspended on pay so they probably knew it was going to end as it did but they have a duty to investigate. If you start counter claiming you'll just look bitter.

Personaly i would ask for her to have some kind of repremand (spelt right?.)

I think it would send out a message that false allegations such as that will not be tolerated. I just wonder if he couldn't get the evidence he had, would he have come out of this with his job. I mean it's obvious he is innocent, but if he couldn't have proved it could have affected the rest of his working life if he was dismissed for harrasment.

I wonder if the ones giving out the negative comments and saying he had acted wrongfully on here will now apologise?.

    Of course not.

Why? He stated post 1 that he emailed her other half and said she was cheating on him whilst drunk, he didn't say at the time that he had taken her word for this as he was that drunk he couldn't remember.

Yes and the later part of that statement says he can't even remember if it was him. He only said it was him when her so called IT expert said he'd traced it to him.

Then if you look at the op's post at 5.15 today he says that it wasn't him as he was pictured watching a football match at the time the message was sent..........

Like i said, i would love to know how this so called friend could have traced it to him.

if the friend was a Facebook employee then there is the slim chance of doing a trace through ip addresses. Otherwise it would have to be through matching email addresses to profiles.
