    I have seen this before in the workplace (haven't we all...) where it has got this serious...if, it has been mutual and you have both been a bit silly here (you wont be first or last) then I think the employers could be reasonable and it wont lead to dismissal. In fact, I have dealt with this as a manager, when relations between two people have soured...it's time consuming and hard work! If of course it has impacted work in any way, including the impact of relationship on colleagues, or anything else we are not in the picture on, then of course that changes matters. You need to be absolutely honest, have your evidence and you also need to consider can you actually work together in the future...as the employer will be concerned over this. The impact on yuor colleagues might be greater than you realise too.

    basically shes thrown u under bus, even though it was a two way. so she never was that into u anyway.

    lesson learned tho... dont mess with people that are attached and never mix work with ur personal facebook.

    we learn more form our mistakes than we do our successes tho!

    So you are texting her 60 to 90 times a DAY? That probably would come close to harrassment

    Anyway, they have nothing but circumstantial evidence, ALL of which most people could replicate in less than 30 minutes.... Ok this is more a kangaroo court, but the tribunal for unfair dismissal won't be.

    Incidentally, if its a Gross Misconduct charge, I would assume the penalty is automatic dismissal or can they 'water' it down as the letter states 'may be dismissal'


    Just because the "charge" is gross misconduct it does not automatically mean that dismissal will happen.

    If the letter states that "this may lead to your dismissal" then that is the company informing you of the worst possible out come to the matter.

    They are covering their backs by writing this on the letter as they are obliged to let you know what the final outcome of their disciplinary matter may be.

    Even if you have deleted the messages off your phone, you can still get them back. Go into a phone shop or a computer shop and they will do it.

    It all sounds really messed up, either you're not telling the truth or she is one messed up individual. I just know that if my job was at risk because someone was making up stories then I would be doing everything in my power to prove that I am innocent.

    I have officially seen all the evidence and there is...none.

    It's her word against my word and my emails, witness statements and character references. She has nothing.

    The company is discounting the FB as they've been legally advised not
    to include it as there's no actual evidence.

    I secured phone records which show I over estimated. There were around 15 texts a day versus 13 replies and 10 emails versus 11 replies on average.

    I've got everything I can, I've written a full statement and rebuttal to all the remarks made and I just have to give it my best shot.

    I can go in with head high knowing I've done nothing wrong and just hope the business see's that
