To harrass someone usually means it is unwanted attention - has she ever asked you to stop emailing / contacting her outside work ?? Has she ever done anything inappropriate to you which you brushed off as you were friends or is this all one sided
If she has been as bad with you you could counter claim harrassment but you would need evidence and witnesses are useful0 -
I didn't claim to sleep with her and her boyfriend doesn't know me at all. I feel totally appalled by my behaviour
I accept I was wrong. I thought the matter was closed and the apology accepted.
I accept I was in the wrong but it seems strange to bring it all up now. I have Union representation on this but doubt they can do much.

Facebook. It wasn't done in my name. It was a created anonymous account. However, I don't for def know it was me. I'm told from the email address linked to the account that it has traced back to me from this IT guy. I genuinely don't know it was me. I am trusting her word on this from months ago.
Don't you have to have a separate email address and receive an email and click on it to access faceache...thus either it's your email address and it sits on a system that you have got passworded - or it isn't.
So either you did this and there would be some trace or you didn't. And if you didn't then why did you admit to it?
Sorry, but this whole thing stinks. I don't believe a word of your faceache story...I suspect it's a ruse to pretend that you have taken the hit on behalf of someone else.

I think I give up. Sorry - i don't beileve the story. I am willing to be convinced, but this is simply a very hard story to believe. You text her 3X as much as she texts you. You have no evidence that it is mutual. There is still , as I said before. something missing in the story here. I simply do not believe it. The entire thing is unbelievable - either you think we are gullible - or you already are. I honestly don't know which is the truth - but none of this adds up.0

I agree with what you say, but if she is saying she has had no contact with him at all the phone bill would have a record of her replying to him via text and also the amount of texts sent back to him. I did not say she might not have replied. I said the reply may have been unrepeatable! Yes you can't proove what is written, but i don't think it would look good her saying there has been no replies from her when the bills clearly could show there has been.Admittedly had it been me - one reply should have been enough and if it wasn't. the police woud have been relaying the message. But that is me. Not everybody can deal with harassment as well as i would. As for Pay as you go, yeah i think you maybe right, but i would suspect the phone company could find the same information out after all it goes from one sim to another, i am sure they could trace it.
As for the rest i agree there must be a way of prooving e-mails etc were sent. As for the facebook, didn't he say it was a false account, so i would assume it does not have any of his details on it.
But thinking about it, setting up a false account to split her and the b/f up would be a good way to open the door for himself to make a move on her.
I appreciate that we are trying to help the OP. But that does not mean the OP is innocent! And the story does not add up. There is a huge assumption going on here that because the OP posted, the OP is telling the whole truth. No, it isn't the case that harassment allegations are always true. It isn't either the case that they aren't.0 -

She has proof - text mesages and e-mails, and a confession by the OP to management that he sent the facebook message (even though he said he can't recall it). And the employer doesn't need proof - they need "reasonable belief", which all of the above is more than enough of. The person who has no proof here is the OP0 -
Thought I would update all.
Hearing is in 2 weeks time.
The files have been handed in and the accuser has provided no evidence. No emails, no text messages and no proof over the facebook allegation. I have provided emails showing accuser encouraging me to text and email and being flirty. Independent witnesses and colleagues have provided statements to back my side of the argument up.
So its word against word really.
Still rather nervous but feel the lack of evidence and my colleagues support is showing that I'm on a trumped up accusation0 -

They have chosen not to present the emails (I have chosen to present them)
And on Facebook, they were directly asked for proof and they said they could not provide this.
Incidentally, if its a Gross Misconduct charge, I would assume the penalty is automatic dismissal or can they 'water' it down as the letter states 'may be dismissal'0
