problem with housing association

Is there?
You seem quite keen for someone else to solve the problem. You're willing to move, if your HA will move you. But have you actually registered your desire to move, and started the process?
i have told the ha , since this started that i wanted to move , as i cant see any end to the antisocial behaviour and verbal abuse i get , but all im told is theres nothing they can do . ive told them i dont mind were i move to as long as its away from here but been told no chance so what am i supposed to do
and no i dont want others to solve "my problem" , i just want advice so I CAN solve my own problems0 -
Have you made an application to move?. That might be the best thing to start the ball rolling. I can only speak of how it works at our council but you need to get yourself on the register and explain the problems you are having. You can do this by phoning them or by going online (ours is only on line, there are no paper ones anymore).
You should also keep a record of any incidents and send these into the council along with any supporting letter you can get from your Doctor stating you need to move for your mental health. Again, only going by our council your case would then be taken before the Welfare Panel or the Medical Panel. This can help you to get a higher banding to assist you in finding a suitable property.
I am sorry you are having these troubles, perhaps you should also complain to your Sheltered Management Team if your warden isn't giving you the support you need?OD [STRIKE] £2600 [/STRIKE] £0 :j Loan [STRIKE]£9500.00[/STRIKE] £0 :j Car [STRIKE]£3150[/STRIKE] £0 :j Moving Costs [STRIKE]£1300[/STRIKE] £0 :j Savings £1150 :j

You have not answered my question - if they do not have other accom available for you, what do you expect the HA to do?Gone ... or have I?0 -
When the warden says 'there is nothing they can do' are they referring to stopping the anti social behaviour or are they referring to moving you elsewhere?OD [STRIKE] £2600 [/STRIKE] £0 :j Loan [STRIKE]£9500.00[/STRIKE] £0 :j Car [STRIKE]£3150[/STRIKE] £0 :j Moving Costs [STRIKE]£1300[/STRIKE] £0 :j Savings £1150 :j

The O/P, without evidence of the perpetrator, is in a cleft stick, police can take action about any anti-social behaviour, it is a criminal offence, but you should bear in mind that the police have discretion whether or not to prosecute someone for :
- attacking another person, causing physical and/or psychological damage
- wilfully damaging someone else's property
- behaving in a threatening or abusive way in order to intimidate or frighten or cause harassment, alarm or distress intentionally
Your landlord could:
- ask the police or the local authority to take action - they've reported it but have they specifically requested action ?
- go to court to get the person behaving in an anti-social way evicted, if they are a tenant or leaseholder - but the perpetrator is not known
- apply to court for an anti-social behaviour order, if the landlord is a local authority or housing association but the perpetrator is not known
- apply to the court for an order to stop gang violence or protect someone against gang violence but the perpetrator is not known
- they can of course re-house the victim, if the perpetrator is also a tenant but the perpetrator is not known
- re-house the victim if the are so inclined to and have the wherewithal to do so with or without the perpetrator being known
So considering the legislation :
- the current HA have no suitable housing stock / or are not willing to re-house
- the O/P has not looked elsewhere to other HA's LA's, but should do so
- there is no evidence of psychological damage to move the O/P's social housing ' band '
- everything else rests on discovery of the perpetrator
- as for the police - read my earlier thread
I'm sorry for the O/P, see #1 - - I'll give odds of 100/1 it will be just a few ' wellard ' 6 stone wringing wet 12 years old bullies picking on the O/P.Disclaimer : Everything I write on this forum is my opinion. ive spoken to the police in my bungalow 3 times now and the last time i was told that -
"as they are only causeing a nusiance there is nothing the police can do as its not a criminal offence ":mad:
also i have asked to be housed by any ha in the county but as my ha wont tell the board that controls the houseing for all the ha's and council in my area that im suffering from antisocial behavior (which would make me top priority to rehouse )then im stuck were i am because the board concider my bungalow adequate for my needs _pale_0 -

I'm sorry to bang on about this basic step, but have you taken it or not? Because as long as you haven't, there is indeed 'no chance'.
Now, moving on from there. Who is aware of this antisocial behaviour and the effect it's having on you? The warden, clearly. The Housing Officer for your property, you say. Talk to their manager. Get a copy of the HA's complaints procedure, and use it. Maybe ask for CCTV. If you've kept logs, use them: do things happen at particular times? If so, see if the police will swing by then.
Have you talked to your GP, if it's having such a bad effect on you? Maybe they can help get you 'medical' points.
I appreciate that you're frustrated by the HA's reluctance to put this down to antisocial behaviour. It occurs to me that they may be doing this because having to move someone for that reason then makes the property 'hard to let' - in the same way that you have to declare any disputes you've had with your neighbours before selling, HAs should be cautious about moving people into properties where there have been problems.
It also seems to me that fencing would help!Signature removed for peace of mind0 -

- from their point of view it is adequate for your needs, as I've said a few times, nuisance is not considered anti-social
"" top proirity ""
- no that's not true - being attacked by another person, and the perpetrator causing you physical / and /or psychological damage, is top priority in your case
"" I have asked to be housed by any HA in the county ""
- they can't / won't help because - nuisance is not considered anti-social and you have not suffered psychological damage, so you, not the HA must approach other HA's or LA's and find an alternative that you are happy with
Look atherlon, I wish I could help you more but the words / phrases that I'm using are the law / legislation / custom & practice / case law in this area. unfortunately you ... like hundreds of others - have to make it happen yourself. camera them or facilitate a move yourself, you are in the dooda, I assume you have no family that can help, and no one else wants to help, so take a shot at doing it within the rules / law yourself.Disclaimer : Everything I write on this forum is my opinion. It's still not clear to me (and I suspect others) whether you have filled in the application forms to be rehoused and got yourself on The List. I don't know how it works in your area, and I don't know if things are different for sheltered / warden controlled housing, but here you aren't allocated a property any more, you bid for those you're eligible for.

i have as stated before requested and filled all apropriate forms to move , but the ha im with will not let the people who allocate all the ha's around my area houses know the situation.
i also got told last week that there was a spate of trouble at this bungalow last year with the previous tenants that the ha now deney
i went to my doctors 4 weeks ago and told my doctor again what was happening and he was so shocked that he wrote me a letter while i waited , which i handed to my housing officer 2 weeks ago in my bungalow only for her to ignore it totally and leave it when she went saying that it didnt make any difference !!!
ive filled out loads ofincident diarys over the last 6 months , first 7 i posted to the ha (all together & recorded) but they "lost them"
without either the ha or police helping me ive no chance of getting out of this situation0 -
Can you not apply to different HA's yourself for a different property?Gone ... or have I?0
