i have stated numerous times yet not one of the 'ventors' on this board has chosen to request the item be returned to customs to be dealt with directly.

its nice to see your £8 garnering such attention from the police.my car being stolen only warrented a visit 7 days after the fact and then it was only to inform me my burned out shell would be towed at my cost if i didnt move it.
or perhaps people like yourself are the reason?0 -
After speaking to the police, they realise the massive scale of this crime, this is a PLC with special privileges, holding thousands of peoples' property to ransom for a charge. They have been doing this for 20 years and not one person has challenged them to account for their behaviour in law.
I have now challenged them, this is my right. I warned the depot worker to seek advice when I was trying to pay for the VAT on my parcel. I told him I would be back to collect it and that I would not pay the charge. I also threatened him with prosecution.
His arrogant attitude stopped him from seeking advice or from acting sensibly and handing over my property, that was his decision, I had no control over his actions.
Three days later I collected my parcel and paid absolutely nothing for it. Now I am realising the second part of my statement, that I would take legal action against him, which is my right, and I am now doing so.
As I have previously written, Royal Mail should inform all of their depot workers to hand over the parcels if challenged. If not, it's the depot worker that will get the knock on the door from Mr Policeman, not the director fat cats at the top :-)
P.S. - I don't have a 'slant', I have the Postal Services Act 2000, what do you have?0 -
i would think you would find as an agent of RM you will not be able to prosecute an employee directly.
given your attitude in writing im sure you were not the innocent party in your conversation.
whom exactly would he have consulted? the legal team they keep through the back?
as ive said RM could solve this by not paying the customs charge.then you could await notification from customs via post and pay it that way.
seems an easy solution does it not?

Again, you are wrong and not taking notice of my posts. Sean O'Hara of the Postal Commission, (The Home of the Postal Services Act 2000) has told me that I have to take this action and that there is no immunity from prosecution.
Why don't you phone him yourself instead of wasting your time writing gibberish nonsense - get it from the horse's mouth.
They don't have to offer this service - it can be paid on-line - direct to Customs.0 -

so you are telling me an employee instructed by his manager/training/set procedures of a large company should just forget this at the say of a member of the public and in going to court this person would be convicted of a criminal act and not the company?
i look forward to seeing the result of this knowing i am now at risk of criminal prosecution every day i work now.

You seem to have the same attitude as those guards at Auschwitz, "I was only carrying out orders". It didn't save them and it won't save you, if you are also breaking the law at the behest of your employer.
At this time RM have failed to prove that what you are doing, if in fact you are holding parcels in lien for their fees, is legal. As such, as an employee in danger of prosecution, you should refuse to comply with their instructions, and you have the right to do so in law.
As for the 'long stretch' Sections 84 and 85 of the Act which depot workers are breaking, carries six months imprisonment and a hefty fine. You have to ask yourself - is it worth the risk that I am wrong in holding this parcel for ransom?0 -

given ive had no notification from my employer i will fulfill my contractual requirements untill that changes
