to the op
what tax code are you on, or were you on in the years. 2008/09 and 2009/10
if your tax code showed a deduction for a taxable benefit and a P11d has never been received from your employer then you will have been overpaying tax.
HMRC are trying to see if the deductions were correct and are seeking to clarify itHe's not an accountant - he's a charlatan0 -
My P60 forms for years in question show the following:
¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬
2008/2009
Total Income for Year: £20865.04
Tax Deducted: £ 3,523.20
Final Tax Code: 324L
¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬
2009/2010
Total Income for Year: £21738.48
Tax Deducted: £ 3609.80
Final Tax Code: 368L
¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬
** My lastest P60 received for year 2010/2011 is below also **
2010/2011
Total Income for Year: £25750.00
Tax Deducted: £ 4412.00
Final Tax Code: 368L
¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬¬
My current Tax code for tax year 2011/2012 is 468L
My latest payslip for April 2011 shows Gross monthly pay is £2250 - tax deducted 371.80
I do also pay into a company pension scheme if this affects anything??0 -
so your tax codes have been greatly reduced - have you received notice of codings for those years? showing why the code has been reduced?
If they mention why the benefits in kind and you haven't received the benefits then phone HMRC say when you last had the benefits and they will recalculate the tax that should have been deducted. (not over the phone, but they will email the back office and it will be done within the next 3 weeks or so.)
HMRC will recalc the tax for the last 3 years, and refund excess tax taken as a cheque and will issue a new tax code for this year which will refund via your wages for excess tax taken since April of this year, you should see this refund in your June Pay Packet
don't bother phoning tomorrow I know from speaking to some people today at HMRC they will be short staffed, best time is approx 8:15 to 9:30 on a weekday morning.
If none of the deductions are valid then you could be due for a large tax refund, which doesn't make the person writing the letter quite so incompetent for all the HMRC haters out there. He's not an accountant - he's a charlatan0 -
Just one thought that nobody else seems to have mentioned.
If the letter you received only includes phone numbers starting 0845 etc then whether you phone or write you will face frustrations and delays.
However if there is a more standard number starting with 01, 02 or 03 that is almost certainly a direct line number for the person who wrote the letter and has continued personal responsibility for dealing with this “enquiry”.
Then you will have a chance of sorting this out in a couple of minutes.0 -
hi thanks for the information. I have not received any notifications about my tax codes - Can you clarify what you mean by tax codes being greatly reduced - sorry not that clued up on this I'm afriad?
Would my company pension scheme have anything to do with this or do you think I have a valid case for a refund?
Should I post a letter together with copies of P60s for the years ending april 2009, 2010, 2011 so they can check or is it best to phone them?
Cheers for your help :beer:0 -

in 2008-9 the standard tax code was 603 L
in 2009-10 the standard tax code was 647L
in 2010-11 the standard tax code was 647L
Something has caused your code to be lower than normal, as as HMRC are asking for P11d's I suspect it will benefits in kind
The lower the tax code, the more tax you pay.
The pension scheme has nothing to do with this.
Phone HMRC next week, confirm you have not received any benefits, they will check the system for P11d's from your employer, they haven't got any (you know this because if they had, they wouldn't be asking you for your copies.) and will accept your confirmation that you have not received any.
They will email the service office to do the calculations and you will have a refund, depending if they have the P14 from your employer for 2010/11 it will be upto April 2010 or April 2011,

I believe it will be an 0845 3000 647 number on the letter, Bootle are trying to clear all the old open years from COP, no personal responsibility for these cases, its simply a question of send the letter, make a note in the electronic diary for 4/6/8 weeks in the future and move onto the next one. He's not an accountant - he's a charlatan0 -
excellent this will be a god send if I get a rebate :beer:0

suso,
I knew it was clutching at straws but it was just a chance. In my latter days at HMRC I regularly failed the quality checks by deleting the 0845 numbers from the letterhead and only giving my direct line number. Officially I was supposed to include both but I didn’t want my “customers” ringing a call centre rather than me0 -

Your tax code indicates your tax allowance for the year - that is, how much you can earn in the year before you need to pay tax. For the current year the standard personal tax allowance is £7475, and dividing this by ten gives the associated tax code of 747L
As suso says, the standard tax allowance last year was £6475, with associated tax code 647L, meaning you can earn up to £6475 without paying any tax.
But your tax code for this year (2010-11) was only 368L, meaning you paid tax on any earnings over around £3685 - so you'll have paid around (6475-3685) x 20% = £558 more than most people.
The most common reason for this sort of reduction in your tax code is to allow the extra tax on any benefits in kind (e.g company car, medical insurance etc) to be collected. HMRC should have been told aboout these by your employer via the P11D form, and you should have also been given a copy by your employer.
HMRC will then often adjust your tax code to take account of this, but they should then send oyu a coding notice to let you know what your tax code is and explain how they have calculated.

But i have no benefits in kind from my employer and have never received p11ds or any notifications what my tax codes are for each year! In a previous job i had company car and use to receive p11ds and also notificatiob of tax code at beginning o year. I think my code may still be showing this benefit - this shud have been removed as i left this employer in 2007. One thing i forgot to mention is i am receiving child tax credits but i don't think this makes a difference to tax codes?0
