Cit_k - whilst we may have disagreed on other points in this thread, I believe making a complaint to ATOS is the very best first step for the OP in these circumstances. However, I would say that I am not sure what effect going to the media will have? Perhaps locally it may have an impact but not sure what the OP will get in terms of national coverage? I don't recall seeing any news items on things like this but am happy to be corrected?

i dont want to stir things, but is he actually entitled to the points and therefore the benefit. I understand you think so but you are emotionally and possibly financially linked.
Look at DLA how many who claim DLA and make their own health declarations are then seen running, roofing etc.

So how many is it. From the way you've described it, I'd think it was the rule rather than the exception!

I bet the nurse did not offer to show the claimaint a copy of the medical report before it was sent to the decision maker either (again worthy of a complaint to the NMWC) as they are meant to (no assessor ever does).

I'd be interested to know how this would be asked for. I am filling out my ESA50 and in anticipation of a medical, I'd like to be forewarned and forearmed. Can I just ask for a report, will it then be sent or can they copy it off? How does it work?

  • If you go on to the NMC's page there is a an icon for complaints.

I tried to post the link but wasn't able to.

    Good luck.

To get back to the initial post the way to complain is directly to Atos Healthcare. I've done it several times on behalf of clients

    This is an excellent site

    http://www.benefitsandwork.co.uk/

It gives lots of free general info but to get the best out of it unfortunately you have to subscribe and it's £19.45 for a full year (there's a 7 day money back guarantee if you don't find the site as helpful as you'd hoped.

As a firm of solicitors we always subscribe to it. I can highly recommend it which is not something I'd usually do if there's a payment involved. Honestly it's worth it's weight in gold.
