Worried daughter - please help to reassure her - soryy long post!

My DD, aged 17, took her CBT in September last year.

DH and I, (both bike riders) decided that as her first bike we would buy her a safe, mechanically sound cheap bike as her first one. The idea being that if she dropped it at any point it wouldn't be too much of a tug on the purse.

In October 2010, having spent some time looking, and lots of communication with the seller we settled on a bike on Ebay from the opposite end of the country. He had continously said that the bike was spot on etc. We bid and won the auction, drove 250 miles to pick it up and was "surprised" (aka very disappointed/angry/upset) at the state of the bike.

Abiding by Ebay rules we paid the money and I jumped on the bike to ride it home. Within two miles, the back tyre exploded on me (leaving us 248 miles away from home). I contacted the seller immediately, he came out and offered to refund our money and pushed the bike home. "What a nice guy" we thought! Didn't have to do that.

Fast foward to this week, saturday a V5 for the bike lands on the doormat for previously mentioned bike, contacted DVLA, faxed letter to them explaining the situation - sorted we thought.

Fast forward again to today, a notice of intention to proscute in DD name lands on doorstep, dated 24.04.11. Doing 50mph in a 30 mph zone:eek:.

I cannot contact police station until Monday, the central processing unit only take calls between Mon-Fri 10-2. DD is panicking knowing that the 6+ points is a license loser as a new rider.

Can anyone offer any advice?

    The NIP will have a section (Section 172 form) to nominate who the driver/rider was. Have your daughter put the seller's details in there and sign it. Optionally you can include a covering letter explaining the situation, but chances are it will be ignored anyway.

    The S172 will be scanned by their systems and a new NIP will be issued to the seller and that will be the end of the matter.

    The V5 came this last saturday- shows the date we "purchased" and returned the bike at 29.10.10 but was only recived by the DVLA on the 21.04.11 - 3 days before offence.

    How can she nominate this person when he might not be the owner or rider ? Not saying he's not but it could be anyone
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    I suspect that he has now re-sold the bike and just sent off the V5 with our details still on it

    Err....I don't think it is in E-bay rules to accept and pay for an item which has been mis-described.
