Err....I don't think it is in E-bay rules to accept and pay for an item which has been mis-described.

When we explained the bike was for our daughter and asked about tyres/chain/sprockets/brakes etc he said all "spot on".
We did not ask about the cosmetic appearance of the bike due to aforementioned criteria (chance she would drop it at some point being her first bike) and it was that and the condition of the back tyre that concerned us, justifiably it seems.
However, back to topic, my query is how does my daughter respond to the notice of intention to prosecute (NIP) as she was not the owner and cannot state who was the driver at the time.Light travels faster than sound - that's why you can see someone who looks bright until they open their mouth.0 -

You have no compulsion to accept a vehicle from an E-bay seller if it has been mis-described, or it being offered in a dangerous condition, unless this had been described as such on the listing.The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

Op, it seems simple enough and I can't see anything to worry about. Take the advice given, all you can do is nominate the guy who sold you the bike as the driver and let it be sorted.
Assuming everything you've said is true there is no possibility that your daughter could be procecuted provided she returns the Nip by recorded delivery.I like the thanks button, but ,please, an I agree button.

Why can't you contact the police station until Monday?
Surely they are open 24/7 and although they won't be able to do anything as such as you have said that the central unit isn't open, they will surely have to log your complaint etc?
As you have said, it's a serious matter for her.
Also, do you have proof that she wasn't at the place the offence took place? Surely that would help as well0 -
Why can't you nominate the previous owner?
His details will be on the V5. If he sold it to someone else, he can then in turn nominate them?
He can also give you the correct details if he re-sold it to change the V5.0
