If someone returns an item, you refund in full and refund what they have paid to return the item? Wow, I've dealt with all the wrong people!
I would as well if it was my error, however this seller isn't going to admit they're in the wrong.
Something that I sold a couple of weeks ago got cracked in the post. (The buyer sent me a picture).
The buyer said that with a partial refund they would be happy to keep it as they could repair it, I sent them a full refund including their p&p & told them to keep the item.

    Perhaps so.

Aside of legal obligations, on Ebay/Paypal you have to refund the full original payment regardless. A buyer can open a SNAD and they will be directed by Paypal to return for a refund.

If an item if faulty, my legal obligations also ensure I must pay the returns postage. So actually I add some customer service and give a refund for change of mind too.

When you are a business, you need to know your obligations.

Just had a message from Ebay !, to say that they have informed the seller and they have 10 days to reply , but this seems strange as the seller told me to open the dispute ...can any of you Ebay experts help ??, or is this just proceedure ??

Just procedure, the seller will need to respond, if they do so quickly then you will need to reply to whatever they say within the time frame ebay give you or else it will close in the sellers favour.

Thank you Hermum !! as you may have guessed I am new to this.... I have never had any problems before, all the people I have ever bought from have been really good, never had any "dirty clothes" or anything like that !!...even if I put anything in a charity bag I wash the clothes first so I really cant understand anyone selling something used without getting it cleaned first !!! and that is not to mention the faulty zip !!!

Hi hermum, what would happen if the seller kept a dialogue running just to run the clock down, if they were the last person to send a message after several messages had been exchanged would the seller still have the case filed in their favour?

    I hope this makes sense!!!!!;)

I would have expected the dress to have been dry cleaned was this too much to have asked ??....any advice ????

If an item is described as "used", then you cannot expect the seller to be dry cleaning the items before selling them. What a bizarre thing to have expected!

The seller does not refund !!...has told me to open a dispute with Ebay !!, which I have now done !!....I have advised Ebay that the seller did not have the dress cleaned before sale, should I have done this ??

not a clever move... why would any seller tell a buyer to open a dispute? I do everything I can to keep them happy so that they don't need to go to ebay/papal
they won't last long, in my opinion

yes you can, and they should. It's somewhere on ebay policies.
I sold an evening dress of mine e few months ago and it cost me more in drycleaning than what I got for it at the auction.

    http://pages.ebay.com/help/policies/used-clothing.html

Used clothing (except underwear) can be listed on eBay as long as it has been cleaned

Assuming dress is dry clean only, then it's perfectly reasonable
