    It doesn't matter if the item has been removed an item not received (inr) needs to be claimed through eBay.


    Edit... Try the EBay forum further down the main page, lots of experienced Ebayer's

    Unless of course the deal was done outside of ebay - which looks like it might be the case.

    On Monday, I got a phonecall from Developing Your Potential about a job advert that I'd applied to. After a short phone interview, I was advised that in order to advance, I should sign up for an online course, which cost 295.00. The whole phonecall was over an hour long, the recruiter was very good at his job and managed to suck me in. I paid on my credit card (thinking if there was a problem, I may be able to dispute it). Literally 5 minutes after the call ended, I searched online and found there have been loads of complaints and attempts at refund from this company. Therefore, I emailed asking for a full refund. Their cancellation policy (which I was not told about) states you can cancel within 14 days and still have to pay 50.00 costs. I have not heard back from them since then. Does this sound right, that I still have to pay 50.00 even though I requested to cancel before the payment had been processed? Thanksin advance

    Hi all

    Ordered a shirt from Hawes&Curtis online through their webstore (8 Nov 2016 and paid £35+£4 postage by debit card. It does not fit. They are arguing it was a sale item and cannot be returned for a refund (they are offering me a different size though) not matter what the Distance Selling Regulation says:

    Hawes & Curtis operates a 3 month returns policy on all products purchased online. Customers who have purchased via our website have the right to an increased ‘cooling off period’ of 14 days after the order has been placed. We offer a free returns service to all UK customers.

    Returning clearance and sales items Online clearance shirts cannot be returned to stores.
    Please note that any items bought in our clearance section can only be exchanged for other clearance range shirts of equal value.

    The Hawes&Curtis head office will phone me back tomorrow (they are escalting it further up).

    Where do I stand? I thought they are breaking the law and the cooling off period gives me the right to return items without giving a reason.

    What should I do?

    Firstly, forget about Distance Selling Regulations. They were superseded by The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 in June 2014.
    A bit of a mouthful, but the principles remain largely unchanged.

    You have a statutory right to return any goods (well there are exceptions but 'clearance goods' isn't one of them) bought online for a full refund of all monies paid.

    As their returns policy points out, they will also cover the cost of returning the unwanted items.

    There is a section in MSE's Consumer Rights guide devoted to distance sales which will expand upon what I have written..

    A family member bought a laptop in store from PC World. It was meant to be new, unused, but had been "set up" by PC World with antivirus ect. That was in July and the family member has been in and out of hospital since then, too ill to talk to them.

    I feel she was duped, but didn't know about it until too many months had passed. I'd like to try and get her a refund.

    Will I get a refund? What are her rights in a situation like this?

    You may feel she was duped, but do you have proof of this?

    Was anyone else there when she bought the laptop?
    Did anyone notice the salesman's 'duping tactics'?

    I'm afraid you'll need more proof than your feelings to get anywhere with this.

    But be aware that this "setting up" is a common trick by PCW to a) get more money from the sale (they usually charge for it), and b) to try and reduce "change of mind" returns by saying it has been used in a manner that is deemed accepting the goods. (i.e. used more than you would, say, in the shop).

    No this thread is for quick questions on consumer rights. The board itself is for consumer rights issues.

    If its just a complaint about customer service, I believe that is the praise/vent/warning board you are looking for.
