That's my interpretation too. The assumption seems to be that boyfriend is responsible for both the insurance of her phone and his as well.

It doesn't appear that way to me ... As I understand the first post the OP's phone broke, they borrowed one to bridge the gap and also made an insurance claim at the same time for their original one (both the loan phone and insurance being provided by the OP's sister's boyfriend). They then sold the insurance replacement and said they lost it and also 'genuinely' lost the borrowed one, leaving the sister's boyfriend out of pocket.

The one the OP had before this sh¡t-storm started, the one that was insured and the replacement was sent for (upsetting the OP as it wasn't an upgrade and was subsequently sold, while simultaneously refusing to pay the excess and claiming it was lost). The sister's boyfriend is only out of pocket by the excess at this point.
The other phone in this debacle is the phone that the OP's sister's boyfriend appears to have lent the OP while waiting for the insurance claim to process, which the OP claimed they left on a bus when the sister's boyfriend asked for it back, putting him about £400 more out of pocket.
The OP claims they can't and shouldn't have to pay for the phone they lost or the excess on the phone they sold. I can't figure out why the fact that the guy who is out of pocket is seeing the OP's sister means the OP should be let off paying the excess or replacing the lost phone.If you think of it as 'us' verses 'them', then it's probably your side that are the villains.0 -

I fear you may, at the very least, need to wait till tonight. Most of our brethren who blag free phones, make dodgy insurance claims, pretend they're lost, sell them on ebay, lie to family and so on, tend to keep later hours than the good citizens of MSE.
Though I have a sad feeling that kmc may be gone for good, having had her fun.

In October, I borrowed a phone from my sisters boyfriend, as my blackberry broke and as he had it registered on his bank account insurance he put a claim in and I agreed to pay any excess and charges they pass to him.
I received the new phone, I asked for a Blackberry Bold as a replacement (I originally had a Blackberry Curve). The insurance said that this wasn't available and sent me a Blackberry curve, I wasn't happy, so when I receivied the phone I decided to sell it and upgrade via Orange. I told my sisters boyfriend it was the wrong one and I wasn't paying the excess, He asked for the phone back so he could send it back to the insurer to get his excess back (I thought it was a bit cheeky of him asking). I told him I had sent it back via the post, He didn't receive it and started asking for the £15. I told him he would have to claim via the royal mail.
He asked for his phone back. I told him he could. I left it on a bus and now its lost. I told him what had happened and I would pay for it. He said "okay, I am a little upset you lost it as it wasn't yours. If you want to pay for it, I searched the internet and the cheapest price is £380 from Amazon, Plus the memory card cost me £20 so how much can you afford a month? I am not a monster and not asking for it all in one go, I know your a student, If you can only afford £10 a month then its fine, If you have student insurance maybe claim off there?"
I feel he is being cheeky asking me to pay for it, he probs has it insured so why should I be out of pocket?
I have ignored him and he sent me a recorded delivery letter threatening me if I "don't pay the whole amount of £415 in 7 days he will commence small claims court proceedings against me"
Help! What can I do? I can;t afford this amount and is there anything I can say that means I don't have to pay him

It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted
