You are not a customer of o2, so they have no contractual responsibility to assist you at all.
This is exactly what I am trying to point out.
When we buy a product we have to accept their term and conditions.
Now lets say I buy a phone and use their contract for 12months, after that I decide to change carrier, if they accept that I can change carrier they should also free the phone in order for it to be used with other carriers(else the phone is kinda useless).
Not being an O2 customer anymore they have no responsibility to assist me which is right but why then restrict the functionalities of my phone?they are still indirectly having contorl over my product.
If i was in a contract and try to cancel the contract asking also to unlock then I would be the wrong one, as i am breaching my contractual promise but in this case as both parties does have nothing to do with each other, they should also not affect each other.

Correct, or rather the original owner did, which may have included terms that aphone may be unlockable. Remember o2 will know the original owner from the IMEI and if they've defaulted on the contract they may refuse to unlock it.

*IF* you have a 12 month contract they will unlock it at the end of 12 months. Usually free, but maybe a small admin fee.

*IF* you have a 18 or 24 month contract they will unlock it but may insist on on payment of the remaining 6 or 12 month line rental. Usually only happens if you've been a poor payer in the past.

Locking is done to tie people for the duration of the contract, it's been looked onto be the regualtor and is considered acceptable as long as the phone is unlocked at the end of the minimum term for no or a nominal admin fee.

The issue is as far as o2 are concerned they have no contract with you, you are not a customer. The fact the phone is locked is an issue between you and the Ebay seller not you and o2 as there is no business relationship.

In effect it's the actions ( or lack of for not unlocking then phone) of the ebay seller is the one that is restricting your use of the phone. Was it bought locked or unlocked / Did they tell you it was locked? Can you ask them if the minimum term has expired?

I understand what you mean but the point is the user can't chase down the other seller for not having the phone unlocked. Those few rights (like the right of the original user to be able to unlock the phone after the end of term) should be transferred to the new user( like it happens in cars) but I think this can't be done as it will require a new registration system.
Yeah I know it was locked, the ebay seller told me and it's not his problem, the reason is that I was waiting for the free unlock that you through the jailbreak of the iphone but that it not coming up,after waiting months ,now I need to go overseas and don't just wanna leave the phone there like a brick.
The minumum term must be expired because if it was on contract and not expired or if they would have not paid the contract then my iphone would get barred.

by the way it seems for now that O2 has accepted my request, they asked me to put an O2 sim card, make and outgoing chargeble call, leave the sim for 24hr in order to link it to the O2 network and then they will unlock my iphone immediately.
Hopefully by tonight this should be done if when they say immediately they mean it literally lol
