Service Provider Unlocking the phone

Hello everyone
I have an issue which I hope someone can provide me a solution to.
I bought an iphone 3gs times ago, the iphone is on O2 but given that I was on 3 at the time i couldn't use the phone so i left it on the desk for a period of time.

Now I need to unlock the phone to use it in a different country, the phone was on was bought on ebay but is originally on O2 which means that it was either a pay as you go or contract phone on O2.

To unlock they are asking to send an unlocking form by telling the number used on it, as not having that number I provided the number of O2 of my sister.

This is the answer I have received today

"Sorry, we are unable to process your request as the IMEI given on the
form has not been used against this mobile.no"

Now I understand that the simcard hasn't been used on that phone
but now I that I need to use the phone overseas, somehow they
are restricting me from taking fully advatage of my phone functionalities

So, what should I do, what is the way to reply and make them unlock my phone?

    Just an idea, but how about telling O2 you do not know what sim has been used in the phone.
    Ask them what you need to do so that they will unlock your phone.

    Thank you for the advice,the problem is that during the application form that requires to be sent they ask for the phone number and other details such as the number that I have called the most from that number.... all details that are compusory to provide.
    If i know more about consumer right I could go saying that i don't know the number but these are my rights so it should be unlocked but I don't know much, I don't know who I should contact in case they don't accept it.

    What i did is replied them saying that the phone is originally from O2 and that is my right to use all the functions of the phone, and I asked him what should be done about it or if I need to escalate the issue to the consumer right

    now I just made that up :rotfl:, I want to know how would I have to deal with them in case they don't accept.

    There's some phone numbers here.

    Ring them and ask them how you can do it.

    Might also be an idea to ask your question in the MSE Mobile phone forum.

    Maybe you don't have any rights to use your phone on another network.
    I don't think it would be a good idea to use the "I know my rights" route.

    I would certainly go to the mobile forum. This is not really about consumer rights :)
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    It's no good giving them your sisters phone number, they need the IMEI (serial) number of the handset before they can give you the unlock code.

    You bought the phone on ebay, so 02 no longer have any obligation to do anything with this phone. The person who had it originally from 02 would have been able to get it unlocked but you are a third party who has nothing to do with them.
