  • I would suggest you wait for the outcome of this case but do be aware with a second claim they are more likely to close your account, rightly or wrongly.

  • So I sent of the first letter then the 2nd one it's now been 3 weeks no response from the 2nd one.
    But the bank keep charges me as I'm overdrawn! when I first started the claim the total was £450 now they should owe be just over £700 what do I do?
    Plus I keep getting these letter through the door saying I owe the bank this money and has to be paid! I only owe it as I'm overdrawn from these charges!

    What do I do? should I start the court appeal now for £700 but im sure i will get charged even more in the next few weeks so do i phone them up and just have a go and try and get a response there and then otherwise I fill in a claim?

  • You can add the charges up until you take the claim to court.
  • Is it possible to claim for charges that you know are accruing but you have not actually been charged for them yet!? Also when you claim back your charges can you claim again if you have a run of bad luck etc.. hoping this won't happen of course....
  • As above, you can add charges until you reach the court stage but you also need to be aware that if these charges take you over the 6 year limit the bank may well discount some of the earlier charges.

    If you make a second claim you are more likely to have your account close/overdraft withdrawn.
  • Help required if possible,

    I am currently at the "seven Days or court stage" and as of yet had no reply,due tomorrow. I have received more statements applying extra charges. My original claim in all correspondence was approx £1700, the additional charges are around £100. To reclaim these charges would I have to restart the claim with the new amount or could I add on the additional charges in the court process,which are not due to be deducted until around the 16th March?
    I don't want to lose out on a technicallity by altering the amount without giving Nationwide the option of repaying me the new amount!

    Any ideas?

  • You could either :

    a) Wait until the charges are deducted, resend them the Letter Before Action with the revised figure, and then start the court claim for the full amount.

    or

    b) Start the claim with the figures you have and then reclaim the additional ones after.

    Either way, you cannot claim charges until they have been deducted from your account.

    What tends to happen with Nationwide is that they pay up pretty easily and quickly, and because they will close your account anyway, they stop all further charges.

  • I have done the first letter claiming £2150 back but have had charges added since that letter. When I send out my next letter do I claim these charges on top of the other one or does the claim amount have to be consistent through the different letters?
