    If you are going to claim again please remember to watch your wording as bank charges themselves are not illegal but the amounts being charged are unlawful.
  • Well, my claim was paid out after they had recieved the letter I had to sign. But on their copy of the letter which I scanned in and had witnessed upon signature, I added in this paragraph:

    "We accept repayment of £2000 in respect of charges from 11.10.00 up to and including 11.10.06. This is without prejudice to my right to make a further claim in respect of unfair charges applied after 11.10.06."

    I am now reclaiming the further £280 they have charged since. These charges, as someone so rightly pointed out, are outside the law and having added in this paragraph which they then must have recieved before paying out, they have basically agreed that my right to claim is still valid.

    Its important that they don't get away with this illegal practice any longer.

    Is it normal for banks to decline direct debits when i'm going through the unfair bank charges procedures.

    I would be grateful for any info.

    This is happening to me too... HSBC called me yesterday saying the are returning a direct debit that was due to come out, I explained to the guy on th phone that I was going through the process of reclaiming bank charges and that it should not be returned, he seemed to agree that it wouldn't but I'm not holding my breath!!

    Hi - some advice if anyone would be so kind.

    I am currently in the middle of claiming back £278 from my bank for charges made against me over the last couple of years. I am at an advanced stage (a few more days and ill be using the final step of going to court), and I have just had my latest statement through saying that I will be charged £150 in charges on 23rd January 2007.

    What can I do about this? I have tried phoning and they say the charges will go through. Can I tag this onto my claim if they are not going to stop the charges? Or will I have the hassle of making this an extra claim starting the process all over again?!

    I've just started entering the competitions (July 07). When I win I'll update this signature. Look on the bright side, I shouldn't have to update it very often.

    When you send your next letter to the bank, or issue your court claim. Add these charges to your claim.

  • Reclaiming charges does not stop a bank charging you if there are insufficient money to cover them. Surely, you were not under that impression. However, you will need to add them on to the claim unless you have filed already, otherwise claim 2 once the first is settled.

    I received a letter today about charges that are going to be applied to my account on 01.02. Coincidently, today I'm putting in the first claim for the charges to the bank. Do I stick in the charges? And if so how do I word it?
