What is difficult to grasp that a company took money from my account when they shouldnt have doesnt need any over analysis. If you cant understand the fundementals of my post then I cant help you.
The bill arrived through the post and it would not have been for 1 month now would it? (come on tell the truth!)
Where did I say it was?!?! Signed up for the phone in January. Took it back the next day. Was told no further action is need by me. Recieved a bill for it in FEBUARY...like I said.
The bill arrives 2 weeks before the money is deducted from your bank account via direct debit.

As the bills are paid in advance with call charges in arrears , the 1st bill would have been for 6 weeks.

So Orange advised you that they were take money from your account, What do you mean "they advised me"? If you mean did I recieved a bill statement then yes, otherwise they didnt advise me in any other way.this you dispute is correct, so you contact the bank to advise them that the money is not due and they stop the DD, the day you notice the DD has been taken you advse the bank and they refund it,Why are you still talking about the bank here??!?! It has already been taken?!?!? I want it back!?!?
the argument then is with the bank and Orange.
If Orange believe you then still owed monies, the debt collection team would then get involved.
?!?!? Yeah cos every company has a sense of morals and duty to the person they exploited?!??!
I must ask why get the handset and then only to return it the very next day?

I have taken stuff back, but not from an irrational purchase, with handsets I view them in the shop try them out and buy if I like.0 -

Usually or in fact? 7 days cooling off period is mandatory only for distance selling. Some shops may offer free returns, but AFAIK it is not the case for Orange shops.
If you buy contract you pay regardless of using the airtime or not. So, if they did not offer free returns, but accepted the phone back, this looks like some free trial in which case you have to pay for days pro-rata.
I said usually because I was on a contract years ago where I was only given one week to return it. Im assuming its all changed now.

Making a point about why I took it back the next day was pointless to me so I enlightened him as to why something CAN be returned the following day.
Of-bloody-course there is a reason to take something back the next day!

Going back to your other post you say Orange never informed you, when the bill arrives through the post , that is to advise you .
It does seem clear though that you are not going to understand that your issue will only be resolved with your own peace of mind or with orange goodwill, if there is no longer a cooling off period then the bill is indeed correct.0 -
There would always have been a bill I just think the op misunderstood that a cooling off period is not a trial, I work in an O2 shop and we offer a 14 day cooling off period, but you are billed pro rata for the days you have it. The line rental which is independent of usage, it's just like your line rental for your land line, even if you don't use the phone its payable.
What might have happened is the bill was Generated before you ceased the contract, so you would have had a full months line rental on there as it is payed in advance rather than arrears, that should have been refunded but again, after months of no refund the direct debit guarantee is your friend, stop attacking people trying to help, accept some fault and just contact your bank.0 -

It was an example. Which is why I told you the real reason. The point I was making is that you can return an item for ANY reason but the fundementals still exist. Someone has taken money from me.
The fact of the matter is that they issued me with a bill I did not need to pay. Oranged accepted my circumstances and they acknowledged this by re-imbursing a refund to me which I am yet to recieve.

I will take your advice. Someone else advised me about the DD guarantee which I didnt know about. Thank you.0 -
Apart from taking out the contract at a trial period which wasnt even used, nothing. I was charged for the months bill for a contract I cancelled and owed nothing on.
I can understand your frustration- been through it myself. Even when you return the phone, they can still charge you for the bill, and then they'll eventually refund you a few weeks later. Sounds like you've been waiting ages- just keep on trying, calling through to 'Orange Channel returns' and i'm sure they'll help you out. Most people on here on just trying to help, hence the reason why they're asking specific questions re returning, paying by dd etc. Hope it gets sorted
