Can my Ex Husband keep me out of my own house?

Hi Guys,

My Ex Husband claims Im not allowed to enter our marital home as he has alarmed it & refuses to give me the code.
As I own this property jointly (in fact I own 80% of it we have a legal document to state this) can he do this?
I want an estate agent to go round at the weekend to value it (its already on the market but changing estate agents) but he says no as the house is alarmed so we cant go in.
I've not been in the house myself for over a year as he lives there.

Thanks x

As this is your ex, did you not come to a financial arrangement as part of the divorce proceedings esp what to do with the house? I think you need some legal advice here.

On second thoughts if he's not budging - go ahead and enter the house 20mins before the planned appointment time. The alarm will only ring for that length of time, but will continue to flash until the right code is entered.

If the property is still in joint names then you have every right to access the property and even move back in if wanted to! Even if you break in you are doing no wrong as it is your property. As it is alarmed I would contact the police and explain the situation, they may be able to help you gain entrance.

    Thanks guys,

Sorry I should have been clearer when I said Ex-Husband, our divorce has not been finalised yet so techinically we are still married just waiting for the decree Nisi to arrive.
He refuses to answer his phone too...x

unless he has a restraining order to keep you away from him you can go in, and you can dismantle the alarm if you like :)

its your house - you can do what you like (apart from changing the locks to stop him getting in)
